    Help with C&R pistol transfer

    Hi, I am preparing to aquire a CZ82 pistol, via PPT at an 01 FFL. I have a C&R and a COE. The pistol is not over 50 years old, but it IS on the federal C&R list. Since this transaction is being done at an 01 FFL does this gun still qualify for the 10 day wait period exemption with my C&R and COE?

    isnt it ca law that for c and r status it must be 50+ ?????? so my guess is no its not exempt from the 10 day

      i thought the 50yr & older thing was just for face to face sales without going through an 01? (for long guns)

        Per CA laws [PC 26970(a)], a valid 03-FFL + valid COE = no 10 day waiting period on a CZ-82.


        Penal Code 26970
        (a) The waiting period described in Section 26815 does not apply to the sale, delivery, loan, or transfer of a firearm if all of the following conditions are satisfied:
        (1) The firearm is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
        (2) The sale, delivery, loan, or transfer is made by a dealer.
        (3) The sale, delivery, loan, or transfer is made to a person who is licensed as a collector pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto.
        (4) The licensed collector has a current certificate of eligibility issued by the Department of Justice pursuant to Section 26710.

        You are incorrect.

        CA uses the same classification of a C&R firearm that the Feds use.

        However, in order to be eligible to be transfered without the use of a CA FFL dealer, the C&R firearm must be a long gun or other and must be 50 or more years old. This exemption becomes void on 01-01-2014. [PC 27965]


        Penal Code 27965
        (a) If all of the following requirements are satisfied, Section 27545 does not apply to the sale, loan, or transfer of a firearm:
        (1) The sale, loan, or transfer is infrequent, as defined in Section 16730.
        (2) The firearm is not a handgun.
        (3) The firearm is a curio or relic manufactured at least 50 years prior to the current date but is not a replica, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
        (b) This section shall remain in effect only until January 1, 2014, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2014, deletes or extends that date.
