    Selling and transfering the same ?

    I hope I am not asking a stupid question. Is the transfering procedure the same as the selling procedure. The DOJ wants a COE and then to be on a centralized list of firearms dealers then I found out that your business license has to have on it " Must be able to sell firearms ". I am getting confused with all these forms. I will not have any inventory to sell as I only going to be a gunsmith. I have a business license and a resale license already and I am waiting for my interview. A mentor would help me understand this better. Anybody out there that has been through this want to message me their number would be great. I just want to do this right .

    Selling and doing transfers are the same.

    There is a form for gunsmiths and the like for the centralized list:

      I am going through this nightmare right now.

      PC12076 states pretty clearly that the city business license must state on it's face "valid for retail sales of firearms".

      When I went before the license review board to get my local license, I had already done everything else.

      (1) I had my (07) FFL in hand
      (2) I had my COE in hand
      (3) I had my sellers permit in hand
      (4) I had DOJ approved safes bolted to the floor
      (5) I had the meeting with local LE and had their approval
      (6) I showed precedence in my city by having printed google maps showing the location of other (home based) FFL's in my city.

      I had the PC printed out, and had an EXACT web address so that the assistant city atty could reference the PC (12076) which states the language which must appear on the face of the license.

      I went before the board dressed nicely with a pressed long sleeve shirt, nice slacks and dress shoes, and I had a binder with all of my documentation ready to reference.

      When it was my turn to speak, I agreed verbally to abide by the (published) home occupation permit regulations which are not deal breaking regulations (no sign, no "walk up" traffic, no advertising etc.). I advised them that my business is by appointment only, described my intended business model as eloquently as I know how to do.

      At the end of my presentation, I clarified my need to have the business license printed as outlined in PC12076 and they agreed and approved my license.

      When I went down the following day to pick up my license, my city (in their infinite wisdom) decided to add "no walk up sales" to the license, which they printed with the words "firearms dealer" on the face (ugh).

      After some polite reminders on my behalf, the lady agreed to have the license re-printed with the words "valid for retails sales of firearms" on the face as I requested, and they originally agreed to. I paid no attention to the additional "no walk up sales allowed" which was printed at the bottom of the license.

      That was over a month ago.

      The day I got my re-printed license, I placed it in an overnight FedEx envelope and sent it to DOJ with my CFD and high cap magazine applications.

      That was 30 days ago today.

      Yesterday I found out that my CFD application has been denied because of the "no walk up sales allowed" language which was printed on the city business license.

      I have spent the last 2 days on the phone with DOJ, the city atty, the license department and have gotten nowhere.

      The DOJ will not issue me a CFD# unless the city license says what it states in PC12076 and nothing else. The women of the DOJ whom I have spoken with are very nice to deal with, and have been trying to help me through this, but they say their hands are tied.

      My only option now is to go back to the (city) license review board and request that "no walk up sales allowed" is removed from my license, and re-submit my CFD application in order to be placed on the centralized list.
      That means another 30 day wait AFTER they receive the corrected license if I can convince the city to accommodate me. The bigger problem is that the license review board only meets twice a month in my city.

      End result, if you are going to do retail sales, make sure the city license says EXACTLY what it is supposed to say and nothing more. DOJ is obviously going EXACTLY by the book on these issues and they are not wavering in the slightest.

      This process has been the biggest pain in the *** I have ever gone through in my nearly 50 years on this planet. The PRK is in full effect.

        Thank you Kemasa. What is the difference between this form and the regular form ? Do I need to send in both ? What does this exempt me from ? Does it mean I don't need a "Local Firearms License Number "

          With the "other" application (centralized list of exempted firearms licensees), you do not need a local business license that says "valid for retail sales of firearms" AND you can sell wholesale to other manufacturers or dealers, but you cannot sell retail to a customer directly or do FTF transfers.

          As far as the "so little time" part of your statement, you better gear up for a long wait. NOTHING happens fast when it comes to licenses or permits. DOJ, BATFE and local city government will have you waiting months before you can conduct your first legitimate transaction. They do not have an "easy" button like Staples has..... lol

            You are welcome to contact me for questions regarding your gunsmithing business. I am not an expert and may not have all the answers, but I can explain what I went through about 2 years ago and what I have been dealing with when it comes to the city, state and feds to get my gunsmithing business set up and running. It is worth all the red tape, but it is not for the faint hearted!! It can blow your mind at times.

            As the other post eludes too, the local City was my biggest challenge as well. I truly believe they are not sure what they want to do with me. The rules change every year I have had to renew, not to mention the fees increase 3 and 4x from the previous year. They are always nice and polite, but like the old saying says, it is really hard to fight City Hall!!!

              Lynn, thanks for your help. I will get my questions in order and give you a jingle. What would be the best time to contact you ? I don't know how long the Q&A will take. Would it be better to meet in person ? I would be willing to meet up at your shop.
