    Out of state handgun transfer

    Hello, I want to purchase an off list handgun. I have a family member from Oregon willing to buy one in Oregon and transfer it to me here in California. Is that legal?

      A Brief "How To Do It" Interstate, Intrafamily

      For an interstate intrafamily handgun transfer, an FFL is required because of Federal law. (Don't count on either the California Department of Justice or many FFLs to remember Federal law.) Filing just a form with the State does not meet the requirements of Federal law.

      The out of state family member may bring the handgun to a CA FFL, or ship it to the FFL if the FFL is willing to accept shipment from a non-FFL.

      Off-roster handguns may not be sold, but intrafamily gifts are transferable.

      Provide a letter of gift - something like

      <Date>
      I, Joe Blow, want my son, John Blow, to have
      this nice Colt Python revolver, S/N 123456.

      Signed, Joe Blow

      John comes to the CA FFL and does paperwork
      If the handgun is off-roster, the FFL completes the Roster-exemption part of DROS screen and writes in "12078PC intrafamily transfer".
      The FFL keeps (a copy of) the gift letter in his files just in case of audit questions.
      Since this transfer will run through DROS, no other form is needed.

      Note that this is still an interstate transfer, and the FFL may charge any fee for this service he may think appropriate.

      If not one of the above family members then no you can't do it, cousins, brother/sister, aunt/uncle don't qualify for the interfamily transfer.

        Above is the way to go if it is the right way of family.
        Intrafamily worked for me to get some of my Dad's and Brothers guns to me.

          Negative, it's a cousin. What we were thinking is he would purchase it in Oregon. And when he comes down for Thanksgiving do the transfer at a FFL here in California.

            I'm looking at the Kel-Tec PF-9 which is not on the CA DOJ list.

              Not going to work from what I understand. Think for DROS you need ID from two CA residents.

              I'm not an FFL and sure one will peek in this forum soon to answer. But I have looked at this same scenario several times as I have a ton of family in Oregon. Just not grandparents or parents.

                Right.

                For a PPT, which would be exempt from the Roster, must be between two folks with CA ID.

                Otherwise, OR resident -> CA resident is an interstate transfer, which is subject to the Roster.
