    Ship handgun to self? TX to CA

    Hello,

    I have a friend who would like to sell a few of his handguns. He owns homes in both TX and CA and while some of the guns he wants to sell are already in CA some are in TX.

    Can he have them shipped by a family member to himself in CA? Or ?

    He has a CA I.D....When they arrive can he sell them right away or does he need to do any paperwork for the DOJ?

    What would his best approach be...

    As I understand it, he has to ship the firearms himself, to himself, and only he should open the package.

    For CA, he would have I think 60 days to fill out the paperwork documenting that he brought his firearms in, the FAQ gives the answer for people who move to CA. I would suspect that dual residency would be the same.

    You are considered to be a personal handgun importer as defined by California law. You may bring all of your otherwise California-legal firearms with you, but you must report all of your handguns to the DOJ within 60 days as required utilizing the New Resident Handgun Ownership Report. You may not bring ammunition feeding devices with a capacity greater than ten rounds, machineguns, or assault weapons into California.

      Can of worms. Personally I would have the family member ship them return address and address to me (which is itself a struggle depending on the UPS counterperson) receive them, send in the registration forms, and sell them right away if I like.

      This assumes legal types and no standard cap mags.

        Handguns must be shipped via overnight delivery. For UPS, you must ship via a UPS Shipping Center (NOT a UPS Store) or from an address that a UPS driver does normal daily pick-ups from. Don't ship handguns with other items. Avoid using a manufacturer's box or writing anything on the box that indicates a gun might be inside. Finally, don't ship any ammo with the gun.

        Save yourself hassles at the UPS Counter ..., set up an online UPS account, create a shipment online, print the UPS label and bring to it to a UPS Center. If it already has a label on it, they will often just take the box without asking any questions.

          Actually, handguns must be shipped via two-day delivery....no requirement for one day. That saves you some money along the way.

            It's legal to do that. Now, try to get FedEx or UPS to ship a handgun without one end involving an FFL. Both of those carriers now have business rules that appear to preclude the self-to-self shipment that is otherwise legal.

              I don't want to be disagreeable, but here's a link to the current UPS policy page on shipping firearms. You can ship long-guns with any service they offer, but I'm pretty sure handguns must be shipped overnight. Here's the quote that I'm referring to ...

              As for getting them to ship it without an FFL involved, I still think the easiest thing to do is open a user account on UPS and set up a shipment from home. You can identify what's in the box when you set up the shipment, which meets the requirement of advising UPS that you're shipping a firearm ... but most often, if a box already has a UPS shipping label on it, the person at the counter will just take the box with no questions asked.

              Of course there's always the US Postal Service ... at least until they finally go bankrupt.

                  UPS and FedEx have their rules, but they allow some who have accounts with them to ship differently, such as multiple handguns in a box and second day air. It is not a law. As I understand it, UPS came up with the rules just before they went public so that it helped with their profits. FedEx followed as they would like more money too.

                    There is also that pesky Federal Code that says if you are a non-licensee, and ship a handgun through the postal service...you can go to jail for 2 years...pay a fine...or both.

                    18 U.S.C. 1715

                    Whoever knowingly deposits for mailing or delivery, or knowingly causes to be delivered by mail according to the direction thereon, or at any place to which it is directed to be delivered by the person to whom it is addressed, any pistol, revolver, or firearm declared nonmailable by this section, shall be fined under this title or imprisoned not more than two years, or both.
