A question for you FFLs. I'm getting conflicting info again.

    A question for you FFLs. I'm getting conflicting info again.

    Is there a legal requirement as to how a gun needs to be shipped from an FFL to an FFL? I have one FFL telling me it needs to be 2 Day Air and another one telling me it's perfectly legal to ship in a different way that I don't remember.

    This handgun is being shipped with USPS.

    What is the deal?

    I was told to contact DOJ but I can't get through to ask a question so I came here. haha

    FFLs can ship handguns via USPS (I use Priority). If they use UPS/FedX they need to follow the shippers policy, usually 1 or 2 day.

      neither federal or CA law requires that it be shipped FROM an FFL. An FFL can accept a shipment from non-licensees, if he wishes. Some FFLs have a personal policy of only accepting shipments from other licensees.

      there is no federal or CA law that requires a firearm be shipped overnight or 2nd day air. that is a company policy some shippers have in order to keep their emmployees from stealing the firearms while in transit.

      If you aren't a dealer or manufacturer, you may not ship handguns via USPS, it must be via a common carrier like UPS or Fedex.

        A nonlicensee may not transfer a firearm to a non-licensed resident of another State. A nonlicensee may mail a shotgun or rifle to a resident of his or her own State or to a licensee in any State. The Postal Service recommends that long guns be sent by registered mail and that no marking of any kind which would indicate the nature of the contents be placed on the outside of any parcel containing firearms. Handguns are not mailable. A common or contract carrier must be used to ship a handgun.

          Ohhhh, I see. Ok, thanks for clearing it up. I think I know what the misunderstanding is: The FFL that told me the handgun needs to be shipped 2 Day Air thinks it shipped via UPS/Fed Ex.

          The other FFL (the one that ships via USPS) is telling me it's perfectly legal to ship it some other way which is perfectly fine too.

            This isn't a legal issue this is a common carrier issue.

            FFL's can use the USPS and can ship handguns USPS priority. Individuals cannot.

            UPS and Fedex require everyone to ship handguns overnight. However if you are a big account, they will give you a discount and let you ship 2nd day. That is where the confusion is.
