    Getting a copy of the DROS paperwork

    I purchased a new handgun today and asked for a copy of the DROS paperwork.
    The salesperson said that I didn't need a copy. The receipt was all I needed. I couldn't remember the PC section that said that I was entitled to a copy if I asked for one, so I didn't argue the point with him.

    My question is - What happens to an FFL if they don't provide a copy of the DROS paperwork when a buyer requests one?

    Nothing. You can report them to the DOJ and they will probably do nothing.

    PC 12076(b)(4)(4) If requested, a copy of the record of electronic or telephonic transfer shall be provided to the purchaser by the dealer.
    (5) If the transaction is a private party transfer conducted pursuant to Section 12082, a copy shall be provided to the seller or purchaser by the dealer, upon request. The dealer shall redact all of the purchaser's personal information, as required pursuant to paragraph (1) of subdivision (b) and paragraph (1) of subdivision (c) of Section 12077, from the seller's copy, and the seller's personal information from the purchaser's copy.
    I would take the penal code in and ask again nicely for a copy. If you are talking about a long gun, it is true that your DROS copy proves absolutely nothing! However, if a customer demands one, I will give them one. At least on a handgun it proves something, but again is entirely unnecessary since you can always get evidence the gun is yours from the DOJ database.

      I agree. Ask nicely and point them to the DOJ FAQ that states they must provide a copy when requested....

        I don't see any reason why a person who puts their signature on ANY document should not get a copy...just seems proper. Especially if what you're signing says things like:

        By signing this document, I hereby certify under penalty of perjury that the information provided is true and correct.
        At least you'll have a copy of the document as it was when you signed it.

            Good question, Baboosh.

            PC 12076 etc. cited no longer exists. Has been renumbered years ago and is obsolete.

            It might be contained in PC 28215(e)(1),(f), but I'm not certain of it.

            PC 28215(e)(1) seems to refer to delivery of a firearm sold by dealer. That is the time for a copy of DROS to be provided to the buyer.

            Compare to subsection (f) which applies to PPT's.

            Makes sense to me.
