    IF transfer, not sure which way to go.

    In your experience, how long do these usually take to go into the DOJ computer from the time they are submitted? I'm buying OR Beretta from gentleman who submitted paperwork two weeks ago and it needs to clear before we can do this. (or so I've been told but you guys know my luck with ffl's here locally)....UPDATE 8/16/11* Ok, I found ffl to do OR transfer BUT, the issue with the IF transfer is still goofing this up, the ffl called the DOJ for me about this issue and the lady at DOJ says it has to "go thru" before we can do this deal, otherwise it will be kicked back, the IF papers were submitted about 2 weeks ago and DOJ says they have backlog and it normally takes about 4 weeks, I then called DOJ myself and was told basically same thing, submitting the form is not enough, it has to be processed. At this point I'm stuck, any suggestions other than just wait it out? If I do it and it's kicked backed what will happen then? Or........does DOJ not have it's ducks in a row and I can just do this no problem?

    Why do you think it needs to clear?

    The PC says
    (A) The person to whom the firearm is transferred shall, within
    30 days of taking possession of the firearm, forward by prepaid
    mail or deliver in person to the Department of Justice, a
    report
    that includes information concerning the
    individual taking possession of the firearm, how title was
    obtained and from whom, and a description of the firearm in
    question. The report forms that individuals complete pursuant
    to this paragraph shall be provided to them by the Department
    of Justice.
    (B) The person taking title to the firearm shall first obtain a
    handgun safety certificate.
    (C) The person receiving the firearm is 18 years of age or
    older.
    Do you see anything there about getting a reply? When you drop your form and fee in the mail, you have satisfied PC 12078(c)(2)(A).

      Thats it?.....I was told it had to clear and actually be on file with DOJ, so if I had go ahead and do this transaction it will go thru no problem?

          Satisfying the PC is one thing as far as the familial transfer goes, but what about the selling? If the DOJ has original owners name and someone with different name sells it won't there be alarm bells?

              Unless the gun pops up on the stolen list, DOJ will not care.

              BTW, you can go back and edit your posts - no need to create a new one, if all you are doing is continuing a thought.

              (MR2Chuck gave dates of submitting the form, and getting the acknowledgement - for him, about 3 weeks).

                  BTW, this is an OR handgun (I have no idea why other than the DOJ forgot about the compact 92) this doesn't effect any of the above correct? OR is ok as long as it's FTF, correct? and....the fact that it's OR has no bearing on any other handgun purchases, If I have a handgun thats taken me off the market for 30 days except for PPT FTF transactions I'm still good to buy as long as its PPT FTF?

                      The DOJ says it has to process buts thats exactly what I would expect them to say, I just don't want to risk a kickback

                        some people recommend that you wait to do the PPT until you know that the vol-reg/intra-family paperwork has been sucessfully processed. Reason being, Person A submits paperwork on 8-1 to vol-reg the handgun. On 8-15 he goes to PPT register it to Person B. the PPT DROS goes through and the gun is now registered to Person B and he picks it up on 8-25. On 8-26, CADOJ gets around to processing the vol-reg and updates Person A's AFS records to show that he owns the Beretta. Will the AFS records be correct?

                          I guess my biggest concern is getting the transaction kicked back and then what happens? Gun goes into limbo?

                            The DOJ doesn't give a rat's azz about the seller and doesn't compare names unless the gun is red flagged for some reason.

                            If the buyer is prohibited from receiving it (the only reason it would be kicked back), the seller gets it back unless he/she is prohibited as well.
