Clarification Need for C&R ship to San Francisco

    Please help!

I bought a 60 year old Winchester 1897 from a Gunsamerica dealer in Massachusetts, they asked me to find an FFL approved dealer to accept the shipment for me.

Is that necessary for a C&R long gun? Is there some additional hoops the dealer or myself need to go through to comply with MA, CA or SF laws or can they ship it direct to me if they have a copy of my Drivers License?

My apologies if there is a thread that contains this information, if so i could not find it.

Across state lines, you need a license holder to accept the shipment. It could be you if you had a C&R license.

Not sure about that new send a letter deal with C&Rs from dealers, but someone around here knows.

Yep, it cannot be shipped to you directly. If the seller is an FFL01 or FFL07, he'll have to enroll in California's CFLC system to ship into California.

If he is an FFL03 or an unlicensed individual, this is not required.

If you have an 03 FFL, he can ship it directly to you once you provide him with a signed copy. If not, you need to find a local 01 FFL (DEALER) to accept it.
C&R long guns are exempt from the CLFC Program, but most dealers don't know this or will still want the gun to go through it to CYA.

That being said, you should have done your homework before purchasing the gun, not afterwards.

          Why didn't I know this?

          Hold on....

This flowchart seems to indicate that C&R firearms shipped between 01 FFLs are not exempt:

While the bulletin may state C&R's are exempt, the specific law itself makes no such distinction...that, along with not hassling to figure out if a firearm is actually a C&R just to decide if they have to get the cflc number makes it easier to just ship all firearms with the letter/number.

Read the first item on the flowchart. If the firearm is a C&R firearm and is being shipped to a C&R FFL holder, then the CFLC is not required.

If they refuse to ship direct, then it has to go to an 01 FFL and the letter is required. In a quick check of the CA PC, I don't see an exemption for C&R long guns for an 01 FFL.

I was intrigued by this bulletin and was flipping through the different bulletins and saw this later bulletin (May of 2008, as opposed to February of 2008), which does not have any reference to C&R long guns being exempt from the CFLC requirement.

I suspect the reason why is that the first message was confusing in that it just meant that C&R long guns did not apply to the requirement WHEN sent to a C&R FFL holder, not to an 01 FFL.

                    Follow up

Just to follow this thread up:
i used Cash Loan Inc, which is a pawn shop in South San Francisco. They were prompt, professional and charged $85 for the transfer. Once the shotgun arrived they called me right away and i went in and did the paperwork, then had to wait ten days to pick it up. I would recommend them without hesitation.

The only other place that I spoke with was Golden Gate Guns who said they charge $120 for the service and the person i spoke with sounded like a shady drug dealer, but maybe I'm just old and suspicious.

The gun store i bought the shotgun from is Roach's Sporting Goods in Cambridge MA, they were great to deal with as well.

Get yourself a C&R license 03FFL $30 for 3 years, no more hassle if C&R long arm....Beware after receipt of license to collect your money starts disappearing and firearms start to find their way to your home. LMAO

                      Congrats on your purchase
