I was talking to a BATF agent about the requirements for a "manufacturer" to engrave their information on the firearm. It is quite strange. If a FFL puts together an upper and lower and tries to sell it, then they need to mark with their name. If a customer orders an upper and lower and the FFL puts it together, then they don't need to mark it. In the first case it is considered manufacturing and the second case it is not even though it is almost the same, the difference being is who decided on what to put together and when it was put together.

So if I order a rifle kit for my shop and put it together on a lower, I need to mark that lower as a rifle that I manufactured? but if the customer orders the parts through me and I assemble it, it's not manufacturing?? Wow! now I'm confused...

Yes, that is what I was told. In the second case your customer ordered all the parts and you just put it together for them and in the first case you put it together as a business and therefore manufactured it. It does not have to make sense as it is the law :-).

From what I was told, you could order complete uppers and lowers and let the customer pick which to put together and then you don't have to engrave your name on it. I am not sure if you put the uppers and/or lowers together when you are considered to have manufactured it.
