    who does what & when

    I just asked a out of state retailer if they would ship an off roster gun to me in ca. and they said yes. so my question is who and when will someone tell me NO? I would put a bullet button on it when i get it if I can get it.

    Sounds like you are confusing two different laws.

    One is the "safe handgun roster"

    The other is the California Assault Weapon Law.

    The bullet button only applies to the AW law, and is only needed if the pistol has "evil features" as defined in the flowchart:


    The roster is completely different. A Ruger LCP is not on the roster, but a bullet button is not required IF you are able to legally obtain one.

    Okay, there are several ways to obtain an off-roster handgun... only one applies in your situation.
    That way would be through a single shot exemption. Either the seller or the receiving FFL (must be an 07FFL, Turners and most "gun shops" can't legally do it) must convert the gun to be "single shot, dimensionally compliant".
    Easy to do on some guns. Replace the magazine with a zero-round sled, lock the sled in place (most often with a longer grip screw), and replace the barrel with one that is at least 6" long, and long enough to bring the OAL of the gun to 10.5"... so for a 1911, a 7" barrel will do it, but for something like a Ruger LCP, it might take an 8" barrel.

    This must be done before DROS.
    Once you pick the gun up after your 10 day wait, you can install the original barrel and magazine.


    To answer your question, you will be told "no" when the receiving FFL is completing the DROS form. If the gun is not listed on the roster and you are not a cop or some other roster-exempt person, you won't even get to the point of walking out the door with a receipt... except the receipt that you'll have for paying the FFL to ship the gun back to the seller.

      An out of state retailer can ship an off-roster gun but your local FFL cannot transfer it to you.
      A bullet button has nothing to do with the roster.
      Never initiate force against another. That should be the underlying principle of your life. But should someone do violence to you, retaliate without hesitation, without reservation, without quarter, until you are sure that he will never wish to harm - or never be capable of harming - you or yours again.

        how exactly does my ffl realize if a gun is banned or not in ca. does he enter a serial # into a database? this gun is a hi point carbine. some are ca compliant some are not. I guess im asking when, where and how in the paper chain do these these no compliant carbines become compliant?

          You need to spend a LOT more time reading.

          The roster is for handguns only. It does not apply to rifles.
          The FFL finds that a handgun is not on the roster when he fills in the DROS form... if the gun is not listed, he can't complete the DROS without an exemption.

          The HiPoint Carbine is not a handgun, therefore there are no roster issues.
          The gun, as supplied by the factory, is a California Assault Weapon. The dealer will know this the moment they open the box to log it into inventory, and they will NOT be happy with you because you will have caused them to commit a felony the moment the FedEx driver drops it off and it will put their license at risk.

          The bullet button must be installed on the rifle PRIOR to it entering California, unless the gun is received by an 07FFL that also has an assault weapons permit.

          Please do not put your FFL in this position. There could be criminal liability on your part for causing an assault weapon to by imported.

            you seem to be saying an ffl would have to first know what a bullet button is,what guns require them, how to spot one, and how to tell if its functional. Or does a company that installs bullet buttons on guns register that guns serial number with the ca d.o.j.? Im just wondering here? as I do like to read, thanks

              Honestly, if you are so unfamiliar with the law that you would make that statement, you are at least a year of study away from being to a point that you should yourself be attempting to build or buy a potentially "questionable" gun.


              No, the serial number is meaningless.
              Assault Weapons are classified in one of two ways:
              "The List"... if they are on the Kasler or Roberti-Roos lists, they are banned in California and there is nothing an ordinary civilian can do to change that.
              The second way is "by feature", and this is what the HiPoint, homebuilt AK47 pattern, and "OLL" AR15 pattern rifles (and dozens of other designs) fall under.



              If it has ANY of the "evil features", it must have a BB prior to entering California, or it must be assembled in California, with the BB attached prior to the barrel being attached to the receiver.
              Beyond that, with or without a BB, if it's overall length is under 30", it is still a felony to possess or transport.


              As far as the FFL, any FFL that is familiar with the law and the bullet button is going to know what guns require it and what guns don't. Heck, 50% of the members at Calguns could do that for you in a dark room blindfolded.

              If the FFL is NOT familiar with the law and the bullet button, he is simply not going to accept the gun from the shipper. He will simply ship it back and charge you.

              And even if the FFL is familiar with the law and the BB, if a "featured" gun arrives at his shop without a BB and he is not an 07FFL with an AW permit, he will also ship the gun back.

                OK so the FFL does have to inspect for a functioning bullet button. I was just wondering how a FFL would definitively know beyond a shadow of doubt if a particular gun was OK. If its cool can I start my year wait now. seriously thanks for your time.

                  It's not that complicated.

                  Study the flowchart that I linked to.
                  Using that information, my buddy's 12 year old daughter can tell you "beyond the shadow of a doubt" about the legality of any particular rifle.
