    Consignment issues

I placed a gun on consignment at a gun shop. Today,I went to the shop, and saw the gun was not in the display case. I asked about it and was told by the owner that it had been sold, and he thought that he had sent me a check for payment. I told him no,I had not got a check sent to me. Now it gets strange.
He went into the back file room, and after several minutes says he can't find any paper work on the gun. He says the gal that does the bookeeping is not working today(saturday) but he will check with her and get back to me Tuesday.(They are closed Sunday/Monday) He claims the gun is still at the shop as the purchaser has not picked it up yet. Time to be worried, and think about a police report,or what?

Not to worry...yet. I usually pay all consignments at the end of the month so if it sells in the begining of the month, you wouldn't see a check for a while...as for not being able to find paperwork...that's a little disturbing...but not unheard of...I'd just check back with them on Tuesday and you'll probably get the answers you're looking for.

depending on how big the shop is, I'd say produce the firearm or the paperwork...if neither appear have them produce a check for the amount.... if that fails time to get the cops involved.

PS I assume you have a copy of the consignment paperwork

I have to go over this time and time again. The cops are not in a huge hurry to go down and investigate or get crazy on a gun shop over a mainly civil issue. Work with the gun shop and you shouldn't have any problems. If all else fails, serve them with some small claims paperwork.

This exact same scenario happened to me at a small gun shop last year.

Apparently the gun was in the safe during the 10 day wait period.

I went back 10 days later and got my money

          They paid me cash

The FFL should not pay until ALL of the paperwork is done AND the firearm is picked up. Until then, it might not go through and the FFL might need to issue a refund.

As was said, give them a chance. Find out when the firearm is supposed to be picked up and check back then.

Thanks for the input. I do have my consignment paper work. After I got home,I thought it was a little strange that he thought he sent a check to me if the gun has not been picked up yet . Hopefully I will get everything resolved when I get a call tuesday. If not,I will be at the shop wednesday expecting answers and a resolution.
