    closed gun shop

I took my daughters rifle to a local shop to have iron sights put on it...he quoted me $70. He didn't get it done for a long time and then closed his shop. I eventually found him and filed suit to recover it. He now claims there is an additional $230 storage on it. Is this legal?

If storage charges were not agreed to in advance, he can not just add them later. The first question to be asked is if the iron sights were put on the firearm. If not, then he has yet to do the work and then storage charges would not apply. In my opinion, storage charges would only apply after the work was done and you were notified that the firearm was ready to be picked up.

Did you contact him on a regular basis to see if the firearm was done?

You might also want to talk to the police about possible theft of the firearm. He can not just take an item and not return it.

What a judge thinks could be anything though.

In oreder for him to charge you storage there would have to be a written contract. I just saw a case on this on cbs 13 call someoneorother.

          Did you win the suit?

          What did the judgment say?
