    Bob was a great guy. Hope he enjoying his retirement. LG, please post more of your policy and price. Can I DROS one long gun and add a few more from you on pickup date on the same DROS? If I DROS more than one long guns from the net, How do you charge?

                      You do not collect sales tax on out of state transfers if it is documented that it is a private sale, an occasional sale and the seller does not have a business, also there are other cases, such as a gift, which also needs to be documented.

                      There are FFLs who don't collect sales tax, either because they don't know that they are supposed to or they don't care. They are taking a huge risk, especially since CA needs/wants all the money that they can get. The CA BOE requires the FFL to collect sales tax, but just like there is a speed limit, not everyone follows it.

                              You can talk to the CA BOE. I am not 100% sure of what they mean, but the CA law talks about 6 or fewer transactions per year. As I understand it, the concept is that if the person buys and sells firearms on an occasional basis, then it is not considered a business. If they constantly buy and sell firearms, then they are a business, even if they don't have all the permits/licenses.

                              From dictionary.com:

                              occurring or appearing at irregular or infrequent intervals; occurring now and then: an occasional headache.

                              The main thing is that yo don't really need to worry about what it means, you just need to get documentation stating that it is a private sale, an occasional sale and that the person does not have a business. One aspect that is bothersome is that if the person has a non-firearm related business, then you might have to collect sales tax, which is not really right, but the documentation talks about it coming from a business and it is unclear what that means. It is not your obligation to ensure that what the person says is 100% true and accurate, but on the other hand, you need to have no knowledge that what is being said is false or perhaps suspect that it is false.

                              That statement is what I was told to get from the seller in order to not collect sales tax from the CA BOE. I am not sure if there is anything official. I suppose one could make a written request.
