    Gift from Family Member

Hi All, I searched , and I couln't find a definitely answer to our scenario. So:

    Scenario:
My sister - who resides in Texas - purchase a gun for our dad as a gift. Dad resides in California - and doesn't know about the gift. She will be coming to California this summer to celebrate Dad's b-day.

    Questions:

Can she bring the gun herself, then once here in California, go to a FFL dealer and trasfer/gift the gun to our DAD?

Or does she have to send it from Texas via FFL dealer to California FFL dealer? And then Dad can go and pick it up.

I did read the main issue here is the Fedaral Law that most be follow.

Note: The gun is an "off roster gun".

Thank you in advanced for your responses.

Legally, Yes, but lineup an FFL first to be sure they will do it.

As was said, you need to find a FFL willing and able to do the transfer. Some/many FFLs are not aware that you can transfer an off-roster firearm from out of state under the intrafamilial exemption, so when you check, don't be surprised if you are told that you can't do that. Just move on to the next FFL and perhaps kindly suggest that the FFL contact the CA DOJ to ask about it and/or read some of the threads here on CalGuns.

Where is your Dad located? That might help with suggestions as to who might be able to assist you.

My dad is located in Los Angeles. And thanks for the heads up on the FFL. Has any one done this kind of transfer/gift before? and what will it cost? Thanks again for all your responses.

Los Angeles is a big place, care to be more specific? I am near the San Fernando Valley, but in Ventura County, as is Fort Courage Armory. There are others that people might know of, but in order to get a suggestion which is close, you need to be a bit more specific, such as the "city/community" in Los Angeles.

People have done these types of transfers before. The cost depends on the FFL, so it can greatly vary depending on who does it. There are no fixed amounts, except for the DROS which is $25 ($19 + $5 + $1). Your father also needs to have a HSC (Handgun Safety Certificate) card, which is $25, if he does not have it and it is good for 5 years. A CA certified lock also need to be included with the firearm, so that you don't have to buy one.

You need to have a letter from your sister documenting that this firearm is a gift to your father, which also includes the relationship (ie. I am giving my father this MAKE, MODEL, SERIAL NUMBER firearm as a gift.

I am not sure of any FFLs in Lakewood, but I am sure others do and will hopefully give you some suggestions.

Yes, those are the basic steps. Make sure that there are no high capacity magazines with it.

The FFL that you use would be the one to determine what would be required. I would doubt that most would require it to be notarized. A copy of the DL would be common. If your sister is married, or in other words her last name is not the same, the FFL might want something to show that, but they might not.
