pick up with a passport?

    pick up with a passport?

    i recently did a DROS for a handgun, my 10 day is up in 3 days. i lost my drivers license yesterday. the place where i did my DROS at ,made a copy of my valid non expired drivers license, would a passport be sufficient for picking up the firearm? or am i screwed since the license usually takes 30days.

    Nope, I tried doing that with my first rifle purchase. Passport doesn't work..

      Hmm, I wonder why a passport wouldn't work. It still establishes your identity. Could be a gun store's policy, written or unwritten.

        passport will establish identity but not residency. It just says you're a US resident, not a _______ county resident. You should be fine for picking up a gun you've already DROS'ed since they just need to make sure that the person picking it up is the person who DROS'ed it. Definitely call the store though and explain it to them and find out what their policy is. We can speculate all we want, but it's their policy that's going to be the final judge of things.....

          You can not start a DROS with a passport, but I do not see why you could not use it for pick up after its been cleared. Your DROS receipt should be sufficient for picking it up.

              As others have said, you should be ok to pick up your firearm. Only thing that would stop you is an uber strict gun shop (they do exist...lol). But they already have a copy of your valid ID (at least they should) so you can explain what happened and you should be good to go.

                So far all of you are going to prison for violating CA penal code.

                From the CA DOJ.



                Clear evidence of identity and age is defined as a valid California driver's license or a valid California Identification Card issued by the DMV. Military identification is also acceptable if accompanied by permanent duty station orders indicating a posting in California, but the dealer must retain copies of both documents.
                Your passport is not clear evidence of identity according to the state.

                Additionally, the penal code states
                12072(c) No dealer, whether or not acting pursuant to Section 12082, shall deliver a firearm to a person, as follows: (3)Unless the purchaser, transferee, or person being loaned the firearm presents clear evidence of his or her identity and age, as defined in Section 12071, to the dealer.
                And as defined in 12071 says
                12071(c)(1) As used in this article, "clear evidence of his or her identity and age" means either of the following:
                (A) A valid California driver's license.
                (B) A valid California identification card issued by the Department of Motor Vehicles.
                So moral of the story, a dealer should not allow you to pick up your firearm unless you have a CA ID, DL, or military ID with duty station orders.

                Any dealer that said you should be good to go is advocating violation of the law and should know better. After all, we are experts on this confusing albatross.

                Of course unless there is an agent present, how would anyone know? However, if I didn't know the customer, who is to say they aren't an agent themselves?

                  As I stated, an uber strict shop will make you wait, and since you've only a snowball's chance in hell of obtaining a replacement ID before your 30 days are up, they would charge you an additional $25 for the subsequent re-DROS, and make you wait an additional 10 days. You may also run into storage fees for all of this as well.
