    Thoughts on This DOJ Response

    From the DMV thread regarding new license delays and gun purchases:



    I called and spoke with the DOJ this morning and this is the response I received:

    I first called the main number and relayed the whole timeline involved and what happened.

    • I purchased the long gun at time of sale providing my expired driver’s license along with the DMV renewal paperwork as well as my DMV vehicle registration
    • I returned after 10 days and was told by the store that my DROS passed but I could not receive my firearm because I did not have the new driver’s license.

    The DOJ person questioned how the store processed the DROS because when they swiped my DL it should have come back as expired. She asked if they swiped it or imputed it in. I told her I didn’t know. She looked the DROS up and verified it was not rejected. She indicated that if the DROS passed and my driver’s license was in fact renewed and I had that paperwork with me (not the physical new one that I haven’t received) then the store should have given my gun as purchased. She then forwarded me to the “eligibility department” to see if they could be of more help.

    I then spoke to the eligibility dept and once again went through the whole process. She too looked up my DROS and verified everything was passed and not rejected. Explaining the same information again her conclusion was the same as the previous person I spoke to. If my DROS was passed and I had the DMV renewal with me to prove it was a valid DL then the store should have given me my gun. I specifically repeated the exact documents I had in my possession at time of pick up. Her suggestion was to have the store call them.

      Once again...DOJ is CAPTAIN CONTRADICTION. It is well known that interim driver licenses are not acceptable when it comes to "valid ID" because they have no picture on them. Also, an expired ID is legally no longer "valid". An expired ID along with the renewal receipt is (as I was told) not acceptable for identification purposes when transferring a firearm. So...I ask...did you get any of this in writing?

        It wasn't me but this response from the DOJ really had me confused given the law and all.

          Calling DOJ is worthless. You may as well be calling Jack in the Box.

          Swiping an expired ID does NOT make it show up expired. It will process fine.

          Its partly the dealers fault for not catching the expiring ID but in the end its your fault for not having a current government issued photo identification.

          Not much they can do but wait to re-DROS.

            No it is DMV's fault, since they have not been renewing people's licenses in a timely manner due to their own screw ups. People have been renewing their licenses on time, but DMV has been taking months to send them out.
            This may be why DOJ now stating that it's OK.

              What identification is required for a person to purchase a firearm?
              Clear evidence of identity and age is defined as a valid California driver's license or a valid California Identification Card issued by the DMV. Military identification is also acceptable if accompanied by permanent duty station orders indicating a posting in California, but the dealer must retain copies of both documents.

              Temporary driver licenses and temporary identification cards (issued without photo) are not accepted forms of proof of identity and age.

              (PC section 12071(c)(1))
              They don't know what is coming out both ends.

              If the customer was talking to them on the phone at your shop, then I would ask to talk to the agent, get their name and number, and ask for the name of number for the other agents as well. I would then write that on the DROS. It is still a risk because they could deny ever having the conversation.
