    SOT Question

    I've seen websites that have multiple automatic weapons for sale and wondered at the FFL/SOT combo they have. I know a Class III can have them but only with a Demo letter, and only 2 of one type. I saw these sites:

    and wondered how they had 10 MP5s for sale. If I wanted to get licensed to buy these, or any other surplus/used from PDs/Agencies, what combo is needed to buy more than 2 without a Demo letter? Or are places like this actually possessing them as "consignment"?

    My main goal, if possible, would be to buy these and others for destruction and sell the parts kit that would result - obviously putting them on a proper destruction form. I believe some smaller PDs don't have an armor that would/could demil them, so I'm guessing they would be sent live before destruction.

    Machine guns break down three ways:

    Pre-86 Transferable
    Pre Dealer Sample
    Post Dealer Sample

    You can't have ANY of these in CA, even with an FFL and SOT unless you have a California Machine Gun permit which is nearly impossible to get.

    Even IF you have all that you still need a demo letter to transfer a Post Dealer Sample.

    IF you had all that you could buy them from agencies (which is VERY hard to do, you must have a very close relationship with the agency).

      The guy I would work with is in Colorado. He would receive them and destroy them, and I would sell the parts kits.

      How are these sites in possession? Via FFL/SOT combo or probably consignment?

        They have to have FFL/SOT to get them. Regardless whether they are a consignment or not.

        Be VERY careful demilling them. There is a very specific method for doing it and BATF is really strict. There is also already plenty of people doing this now and there is not much money to be made anymore. PD's know to shop around to see who will give them the most for it.

        Also HK will probably refuse to sell anything to you after they learn that you demill their products. They hate that.

          This might be the best thing to remember.

          I know you needed to be an FFL/SOT - I just didn't know which one. FFL01/03, FFL07/02, etc.... This is more where the main question is.

          I've been at the ATF site looking at their required way. Seems to apply to imported machine guns, but I'm sure demilling a domestic the same way will be accepted. I can always verify with the agent doing the inspection:



          If I could have bought those for $700, I see them on GB generally for $1300 and up and selling at about the $1100/1300 mark. Not too bad profit....

            The problem is CA. I have my 01 FFL and SOT. If I lived in Free America, I would have FA, SBRs, and SBSs. As it stands, the only thing I get to play with in CA are silencers and AOWs.

            As was stated you would need a special weapons permit to do the fun stuff in CA.

              If you want to manufacture NFA stuff you need a 07FFL and a 02SOT(also covers receiving/selling) if you just want to receive/deal in NFA stuff you need a 01FFL and an 03SOT
