    BATFE/DOJ inspections - Home FFL

    In regard to BATFE inspections for a home based FFL, a few questions:

    There will be a specifically defined office area in one room where business will be conducted. It will contain a desk and file cabinet with all records and a safe for inventory. There will be another safe in a separate area of the home for personal firearms. Will BATFE have access to this safe as well to inspect the contents? Will BATFE have access to the entirety of the home as well?

    This same question also applies to Cali DOJ. What can they inspect?

    I'm not paranoid and everything in the home is legal. I just would prefer to know in advance where they will require access.

    I have not heard of any instances where they wanted to do a complete search. I have one area used for business purposes and that is the only area they are authorized to see, the rest is personal/private space behind closed doors. When ATF and DOJ was here, they were very respectful that they were in a residence.

              CA, statewise, does not have any prohibitions against home-based FFLs. ATF doesn't have any prohibitions against home based FFLs. ATF does say that your local jurisidiciton must allow for a home-based FFL. Some cities/towns don't allow for home-based FFLs, others do.

                  A friend of mine just went through an inspection last year at his home. He is a home based FFL. No problems at all. The inspectors had no desire to inspect the whole house. Very painless.

                    First, my agent stated if she ever wanted to search a home based FFL's non-shop area, she would have to get a warrant.

                    Second, the ATF doesn't care one bit about where your license address is. They will issue a license to anyone, anywhere.

                    Now the CA DOJ will not issue you a CFD so you can lawfully deal guns in the state unless you have a local business license. Your local business license agency will be the one to restrict your FFL based on zoning.

                    That is the way it works.
