    Restraint order that was dismissed. When can I DROS?

    I wanted to see how long before I can DROS my handgun after a restraint order was dismissed?

    I had a firearm I purchased and waited to DROS it as I was told a I was going to get a restraint order against me from a friends job. Anyway, I was never served and the temp order was granted (since I didn't show and wasn't served), but the perm order was denied (of course, it was bogus).

    Anyway, how long before I can DROS the firearm since I have been waiting awhile to finally get this and its been paid for awhile back? When does DOJ see/find out it was dismissed?

    You can DROS when DOJ clears it. When will they clear it? It could range from soon to never to when your lawyers force them too. Sucky situation, I know, been there done that. I had to pay lawyers to fix it. If you need a recommendation for a lawyer, let me know.

      Fill out this form: Personal Firearms Eligibility Check

      Send it off with $20, wait for the response. If you're good to go, great. If it comes back with a negative response, you're in for a possible five-alarm headache trying to get all the "proof" from the court into DOJ's data base.

      First step though is the form...see what happens, then you can come back for further instruction.

        DOJ response was print a paper online showing it was "declined" from court web site. Which is does say that. Then give it to the dealer if DROS comes back declined. The dealer will fwd it to the DOJ.

        I might call them back today and see if I can talk to someone else.

          That is the worst advice I have ever heard. How in the heck would I forward it on to the DOJ? I don't communicate with them very often and I have nothing to do with denials. I swear the DOJ are nuts sometimes.

          Be prepared to forward that yourself. It really isn't the dealer's place to do your legal work let alone the fact the DOJ won't talk to me about your case anyway for privacy reasons. So if you do get denied, you will need to contact them in all likelihood.

                Just called them (before you posted number) found number on Google. Lady gave me some advice (call court house) and make sure the "flag for RO was deleted".

                  Ok. Called court house. They said to call Sheriff dept. I called them. Lady said she needed a paper showing it was dismissed or denied. I said I see it online, she said she didn't. Got showered and ready to go down there. I called back to see if they needed a minute order or what? Another lady answered and said she saw it was denied. She said DOJ never got the "clets" order and I was fine, no worries. I asked if everything was good then and I didn't have to come down to show proof? She said no, she saw it was denied and they didn't send anything to DOJ. Ill post back in 10 days

                      I pick it up this week if all goes well. When will I hear something "normally" I know I can at the last hour, but what is normal? Few days before the 10th day or?

                        There is no "normal"...if something comes back negative...we can get a call at any time.
