Store Front Location Had To Move. How Does This Effect My FFL

Hopefully a very experienced long time FFL dealer can answer this question since ATF can not. I have been at my current store front location for several years. My lease is up in 2 weeks and my lessor will not renew the lease. Here is the problem. ATF requires a 30 day advance notice before moving your location which also must be pre-approved. Problem is I was under no impression that my lessor was not going to renew my lease. Now I am stuck without an ATF approved location to conduct business or store my inventory. Could someone please give me some factual advise since ATF basically will not answer or address my problem.

Fill out the form ASAP! Send it in. If you have to be off the premises ASAP, just move all the guns to the new premises or to your house until you get moved over. Don't sell anything until you get your new license and then send it in to the DOJ and get your new CFD.

What else can you do? I mean are they going to arrest you because you moved the guns to a more secure location instead of leaving them at the premise address that you no longer control? No way in hell.

Also, you should have a local ATF auditor that you deal with. Call him/her directly. My auditor out of Fresno answers all of my questions and she is a huge resource for me. Try your local office and let them know the situation. They tend to be more caring and more willing to give answers than the national numbers. Plus the local people are the ones that are going to correct your actions so they are the best authority.

Basically your landlord is a mother fer for doing this to you. I would check and make sure two weeks is all the notice they have to give and possibly take legal action against them since this is going to cost you to be down during the best retail season.

I agree, make a call right now & get moving in a forward direction. Take your stuff when the lease is up & transfer it somewhere safe. I have only had good experiences with the ATF - they seem to be people just like you & I...

Check the codes of your state. In many places they would have to give you written notice to vacate the property, even after the lease expired. From the point they did that you would have 30 days to vacate the property.

I just went through that process. I only moved three suites over but it changed my address so I had to get ATF involved. The process is basically the same as the initial process. They just speed things up. It will still take every bit of the 30 days. However, you had better have a new address for them to "approve", (including changed city, state, sales licenses.) That will be a stumbling block otherwise.

Thanks all for your input. I am in Nevada and once a lease expires they can refuse to accept the rent payment and you have 15 days to vacate the property. We do not have a resident ATF person here anymore. Our ATF contact comes up from Sacramento to address our needs. The current ATF contact is also a new employee in training and has only been with ATF for about 3 months. This just really sucks because I can not conduct any sales until I get the new license back from ATF. I also do a lot of transfers for auction companies that do estate & bankruptcy sales. Thus I will be losing this income also.
