    a what if?

    lets say a dealer who is not an assault weapons dealer took in a listed by name rifle and sold it out of state, what are the possible legal problems? could the ca doj nail is *** for it during a audit or if they audit him and he still has it?

    Yeah they could... they have an AW in their possession and they don't have an AW license...

    per my DOJ agent buddy he's seen FFLs get into trouble for even bringing in AR-15 type guns and installing them once they get into the shop.... technically a no-no

      Technically it is illegal. That being said there is no way the DOJ would know about it unless it was in their inventory at the time of inspection. When you have a DOJ inspection they do not look at your bound book, unless you put state info in it. i.e. CFLC numbers DROS number etc.

        Yes, in theory they could look at the bound book and say something. Just keep your mouth shut and don't do it again. The odds of them discovering it is slim and as the years go by, they get even slimmer.

        If they do discover it, you have a right to remain silent. Do so.

          If I remember right, most felonies have a three year statute of limitation; however, if the AW violation is a felony punishable by a term of 8 years or more, the SOL is for 6 years.
