    Family transfer form

    Hey gang,

    I want to gift one of my handguns to my daughter now that she is 21. Do I have the right form? FD 4544A

    Who fills it out, the form instructions say, "the owner", the giver or the receiver. It only shows 1 signature so I assume the receiver fills it out and since the form contains the serial number, that is how the gov cross checks it. Just a guess though.

    Another question, is there any length of time that I must own this gun prior to the transfer? It's a new purchase for me and she turns 21 next Friday.

    Well I might have answered one of my questions by reading the form from the receivers point of view, I assumed that the giver should fill it out since I would be gifting it to my daughter. One of the questions asks "Obtained from" and the other was "how obtained" The giver is the obtained from and how obtained is gift.

    So what say u about the form, is it the correct one? How about any time limits on giver ownership?

      That is the correct form for Intrafamilial Handgun Transfers.

      Are you both CA residents? If so, you can hand her the firearm and she has 30 days to fill out and send in the form with a check for $19.

      There is nothing specifically in the PC which states a period of time.

      If she is turning 21 on Friday, why not buy the gun, have it shipped to an FFL, and go down with her so she can DROS it originally in her name? Saves you the added cost of DROS/transfer in your name, and then the $19 on top of that. I'm assuming she is going to have to go to a shop anyway, since she needs an HSC card and will have to take the test, unless she is exempt?

        Your daughter fills out the form. There is no time period.

        BTW, she does not have to be 21 to be given a handgun, just over 18. She can not buy a handgun until she is 21, but a parent can give her one.

        Also, it was said that the firearm was a new purchase, so it has already been transferred to him and using the form means that the HSC is not required.

          the transfer to DOJ, pursuant to Penal Code section 12078(c)(2)(A),
          within 30 days of the transfer. You may obtain Form FD4544A

                just one of those things where the recipient needs to have an HSC, but does not need to inform CADOJ that they actually do have an HSC. I do recall an 18-20-year-old CG'er sent in an intrafamily form and someone from CADOJ called him trying to claim that the transfer was not valid because he couldn't haven an HSC card, and one was needed to complete the transfer. the CG'er told the person that he did have his HSC card. The CADOJ person did not realize that an 18-20-year old could get an HSC card.
