FFL to FFL pistol?

    FFL to FFL pistol?

    I want to sell a pistol from my personal collection to someone else in CA that does not have an FFL. Can I just send the pistol with copy of my FFL to his FFL dealer? And have them handle all the paperwork? I assume I have to enter it into my book (from my personal collection) and then show it sold?

    Trying to avoid doing the DROS myself. As I've only dealt in rifles. And don't know the process at all.

    From ATF website:

    A licensee may sell a firearm from
    his or her personal collection, subject
    only to the restrictions on firearm
    sales by unlicensed persons, provided
    the firearm was entered in the
    licensee’s bound book and then transferred
    to the licensee’s private collection
    at least 1 year prior to the sale.
    When the personal firearm is sold, the
    sale must be recorded in a "bound
    book" for dispositions of personal
    firearms, but no ATF Form 4473 is

      You as an individual can send them the pistol without using your FFL.

      The main point of the not selling guns in a year thing is for Free America where people can still sell guns face to face without an FFL. This is to prevent you as a dealer from just saying the gun was in your personal collection so you didn't have to fill out a 4473. If a 4473 is filled out, then the one year rule doesn't apply. So I think if you sign the gun into your book and ship it to the other FFL, you are fine because you are not doing a face to face to avoid a 4473. You are sending it to another FFL that will have to do a 4473 to get it to the end user.

      Me personally, I would tell you to just send it to me as a regular citizen and I would DROS it to the customer (assuming it is on the CA approved list of handguns for sale). I don't have to get a CFLC if it comes from you and not the company.

        Is a Colt .45 on the approved list of handguns for sale? I think if I sell this gun to this local guy. I will just make him come up with his own local FFL. So I can simply send it to his FFL for DROS'ing. With a copy of my FFL. That seems the easiest to me.

        Otherwise doesn't the original owner have to show up (in a private citizen sale) to sign paperwork?

          The only Colt that isn't a .45 on the list is the 6" Python. The list is more geared toward model numbers. Here are the CA approved Colts (minus the Python revolver)

          And yes...if your gun is not listed here, to sell it in CA, it must be done at an FFL with buyer and seller present (unless it's a C&R).
