DROS question about serialized upper, not lower.

if the firearm i want to DROS has the serial number on the upper, not the lower, can i detach the upper and just DROS that? of course it has a 16" barrel.

can it be done as a receiver or does it need to be DROS'd as a long gun?

If the receiver was EVER manufactured into a rifle (buttstock + rifled bore) or shotgun (buttstock + smooth bore) then you cannot 4473 it as a receiver, because even though it's broken down into the receiver, it's no longer a receiver by federal law.

You can't DROS a receiver as anything but a handgun or longgun anyways, so that part doesn't matter.

But you must describe it on the 4473 as a rifle or shotgun now.
    Please read the Calguns Wiki
Laws that forbid the carrying of arms...disarm only those who are neither inclined nor determined to commit crimes...Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man.

i see, cool, thanks. so if i did bring just the upper and DROS'd it as a long gun, would overall length then be an issue?

Only if it is operable in that condition would the length matter. If the gun is inoperable, then the length doesn't matter.

Also interesting is if the person is under 21 or not as they can only buy long guns on a 4473.
www.tenpercentfirearms.com was open from 2005 until 2018. I now own Westside Arms.
