    FFL fud or truth?

    So I bought a handgun on gunbroker and set up all the transfer stuff blah blah, it comes with 2 15 rounders, I knew this, no big deal. My FFL's transfer rates are all really reasonable and he is a good guy but I think he's got a lil FUD. He told me he would convert them to 10 rounders for 15$ a piece ok ok honestly thats not HORRIBLE. Problem is I could do it myself, but he says he cannot legally give them to me even in a parts kit. I know sometimes FFL's have to play by different rules, so is this FUD or not. Could he give them to me as a parts kit so I could change them? (it's not going to matter, he isn't going to take the chance) I just want to know if I'm right or not.

    He's playing it safe. He could either give you your parts or, you could have the seller send you the parts kits and just send your FFL the firearm.

      yea I didn't make a big deal out of it, I totally understand him playing it safe. just a bummer, oh well its only 30$ i guess. hopefully

        and remember that you must have at least one working mag available to do the handgun safety demo. so, if all the mags are currently part kits at the dealer, it may be impossible to do the required HSD. So, the dealer would either need to assemlbe one mag into a large-capacity magazine to do the demo, which might violate 12020, or have one made into a 10-rounder, or if he had a compatible magazine from another handgun, to do the HSD. Or, if he gave you the parts kits beforehand(which you said he won't do) then you could bring one back as a 10-rounder to do the HSD when you picked it up.

          I already have a 10 rounder that I bought ahead of time, plus I think they will be converted by the time I pick it up. Thanks for that heads up though

            He is incorrect. He can legally give them to you as parts kits. If he does not give them to you as parts kits, that is his personal choice and company policy. There is a difference between legal and individual business policy.

            I wouldn't break the guys balls over it, but he didn't have to do it.

            Find out how he is modifying them. The modification must be permanent.

            Next time pay the seller an extra ten bucks to just send them to you direct.

              yup will do, and not busting anyones balls. I fully respect his choice, the only thing is he thinks it is illegal. But I'm not gonna bring it up again, no biggie.

                Just be polite and let him know you did some research and there is no requirement he must modify them. If he disassembles them, they are no longer magazines and can be sold as parts. If you reassemble them into large capacity magazines, then you are manufacturing in violation of the law, not him.

                If you really want to test his mind, let him know that there is no prohibition on the purchase of large capacity magazines and because he is exempt due to 12020(b)(21) and (26) and can legally sell large capacity magazines to anyone at any time.

                Again, let him know you are fine with the $30 and no big deal. Just having a friendly discussion.

                  Can you have a gun and a disassembled high capacity magazine sent to an FFL dealer.. and bring a 10 round magazine from home that is compatiable with the hand gun being bought to do a hand gun safety demo?

                  Can you have a gun bought sent to an FFL dealer and a disassebled high capacity magazine sent to your home... You make the high capacity a permanent 10 round magazine...then bring that 10 round magazine on day of gun pick-up to do the safety demo?

                  How much does a gun smith charge to permanently moda hi-cap mag to 10 rounder?

                  Anyone have a good link to mod magazine to be permanent 10 rounders? Do you have to buy parts..ie shorter springs?

                    yes to your first question.

                    yes to your second question if the seller is willing. (most out of CA are not)

                    the charge varies greatly

                    there are sticky's in the handgun section of calguns on how to do it

                      Thanks for the prompt replies. I had a similiar experience as you... 3 of 4 FFL dealer saying one thing..and the lone FFL dealer saying another...all saying they were right. Reading thru calguns and the law.. The one FFL dealer was right.

                      Told I had to buy a DOJ approved gun Safe, not cabinet, and that it would exempt me from having to buy a gun lock for each time I bought a pistol. WRONG.

                        For transporting purposes maybe? Cuz with long guns, if you have proof of a gun safe you don't have to buy the lock. pistols may be different.

                          Pistols are different. Per federal law, all pistols must now be accompanied by a lock. There is no such requirement for long guns.

                          For the state, every single one of your firearms must have a lock or you must have a safe and sign the safe affidavit.

                          Merging the two together you must have a CA approved FSD (as dealers can't give you anything else) for every handgun and long gun or have a safe affidavit for long guns.
