Hi all, I am flying out to see my dad who lives in Florida he is going to be giving me 2 shotguns and 2 .22s. Do I have to do an FFL to FFL transfer with these?

I called one FFL in FL and they said it was none of the GOV's business and that I was fine. The next one I called said I had to do an FFL to FFL.

It has to go through a FFL to be legal because you live in a different states. Due to that, your father can not just give you the firearms. This is a Federal, not a state issue.

You do not need to do it FFL to FFL, just have your Dad ship the firearms to a CA FFL and do the transfer. Since all the firearms are long guns, you can ship the firearms for the same price as a FFL (handguns can not be shipped USPS (cheaper) by non-FFLs, with some exceptions). You need to ensure that the FFL is willing to accept the firearms from a non-FFL. Also, you need to confirm the FFL's status on the BATF ezcheck web page. FYI, the BATF says that FFLs should not give a copy of their license to a non-FFL.

You should also include a letter stating that it is a gift so as to not have an issue with sales tax. Even if the firearms were to be sold to you, it would be exempt, as long as you have a letter.

Federal laws [18 USC 922(a)(3)&(5)] prohibits firearm transfers between residents of different states, unless the transfer is done through a FFL dealer in the recipiant's state of residence.

You could make a case that he could also do the transfer at a Florida FFL.

Federal law says an unlicensed person can acquire a rifle or shotgun at an out of state FFL, as long as the rules for both States are followed. Because it is a "family" transfer, it is exempt from the California requirement to be processed through a California licensed dealer. So the Florida FFL would be able to follow the rules of both States.

I doubt any Florida FFLs would go for it though.

It does seem reasonable that the FL FFL could do the transfer, but I think it would confuse everyone and I do also doubt that you could find a FL FFL who would be willing to do it.
