PPTing handguns to yourself as an FFL

    PPTing handguns to yourself as an FFL

    How many handguns can I PPT to myself in a year? I was told 5 or 6, seems unfair since non FFL CA residents can but 12 a year. Maybe I misunderstood.

    03FFL + California COE can buy as many brand new handguns as he wants (no 1-every-30 rule).
    Non-FFL can PPT purchase as many handguns as he wants... the issue is sales that draws the attention of the DOJ/BATF that you may be acting as an unlicensed dealer.

    I've never heard of any rule that an 01/07 FFL can't buy more than a few guns per year... but I'm not quite sure what you mean by "PPT to yourself"... but I'm only an 03FFL and am not familiar with the 01/07 rules.

      A customer comes in and wants to sell a handgun. At the time I had no Secondhand Dealers License, so I PPT'd the guns to myself because I could not pass up the deal. I guess if I do a regular transfer now that I have my Secondhand Dealer License that should be ok. I just found it interesting that I would have a limit. Maybe they mean PPTing from me as a seller and not as a buyer, the whole sales tax thing.

        The main thing is federal. The feds don't want you buying guns for yourself because in FA (Free America) there is no 4473 required on private purchases. That is why you are supposed to wait a year before you can sell those private purchases.

        However, that says you have to wait a year if you don't use the 4473. Since you are PPTing with a 4473, then the keep it a year rule in my opinion doesn't apply.

        Now, are you doing something against CA by PPTing and not complying with second hand dealer rules? Possibly. Might your large number of PPTs attract some attention? Maybe. Is there anything they can do about it? I am not sure.

        Federally I think you are clean because a 4473 is involved. State, I am not sure.

          I thought it was a tax thing, relating to the Secondhand Dealers License, but when I sell it through the store it gets taxed. The only thing else would be the serial number check, but that too would be addressed in selling it through the store with the DROS. Am I right?
