    Secondhand Dealer Reporting Requirements

I'm not a secondhand dealer but I am curious: how is this "electronic submission" done?

    SB 449 (Stats. 2009, ch. 335)
•Beginning July 1, 2010, secondhand dealers will report daily to DOJ (rather than the local law enforcement agency) via electronic submission

Also, what is required to become a secondhand dealer?

Without a Secondhand Dealer permit(?), am I prohibited from buying a customer's used firearms?

Please forgive my ignorance but I'd really like to know more about this but don't know where to look.

ETA: A google search confused me even more. It seems CA has had secondhand/pawnbroker laws on the books since 1957, but permits are issued at the local level, not state. Also, not all localities require them. Is that correct?

In June it is supposed to go electronic and bypass the local PD. I have not heard yet how this will work. I asked the local Sheriff's department and they hadn't heard either about how this will work.

OK, another $200+ just to be able to take-in a customer's used firearms for resale

And what about the form they will need to sign and put a thumbprint on. Anyone have an example?

          Help greatly appreciated.

Shoot me an email and I will forward it to you. It used to be a three part form. This is the form i got from the DOJ about a year ago. Your local PD might have a different form they want you to use.

Oh and $200 is just for the state. My local Sheriff charge another fee on top of that. Annually!

Yeah we were confused by this also. But what our city PD guy told me was just to send the form in. I told him about the electronic thing and he said they are still working out the system... figures!

                      Part of the notice is:

I’m a licensed California Firearms Dealer (CFD) only. Am I required to use
FDAS to report a buy transaction?
                      A. No. At this time FDAS is only set up to be used by secondhand dealers and
pawnbrokers. Although FDAS may be available to CFDs at some point, currently
all CFDs must continue to submit the existing Firearms Dealer’s Report of
Handgun Acquisition form (BOF 4334) to the Bureau of Firearms.

So for us little guys, that are not licensed as secondhand or pawn, how exactly does this apply? The new law indicated "firearms" not handguns, so I understand that to mean ALL guns. At what point does one need a secondhand license (how many rifles and handguns must one take in annually that would require being license).

Bringing this BTT for an answer to remington's post above since I would like to know as well. I already had a client want to sell me his used rifle but I wasn't sure I could legally purchase it without the second hand dealer stuff in place. Thanks.

Per the DOJ at the FFL meeting a couple of months ago, they said anyone buying or selling used firearms needed a secondhand dealer license. I would disagree with them but that was the answer they gave.

^This is the sad fact. If you take in 1 firearm for resale...you're supposed to have a second hand sellers permit.

Thanks for the clarification guys. Now another question; I already have a COE, so will another LiveScan be required for this?
