    S&W 5906

    Hey all,

FNG here. I have a 1st Gen S&W 5906 that I bought new in California in 1990. I have the two factory mags that came with it, both over 10 rd capacity.

    1) Am still allowed to keep the mags?
    2) Any implications if I sell or trade the weapon since I'm told it's currently not on the "approved" list?

    Thanks!

    1) Yes, But keep them, you can not sell them or give them away in California.

    2) No, Private Party Transfers are not affected by the Handgun Roster.

You can sell the magazines in CA, but only to a firearms dealer. Depending on how you read the law, the firearms dealer should have a high capacity magazine permit.

Since you can not buy them again, it is best to not sell them unless you really have to.

Thanks, I'd only sell the mags if I was selling the handgun.

But it sounds like the buyer, if in California, would only be able to buy the pistol and not the mags? Kinda frustrating.

Even if you sold the firearm, it would be best to keep the magazines. Outside of CA, people can buy high capacity magazines, so the magazines can be replaced by them, but not by you should you decide to get another firearm in which the magazines can be used.

Yes, in CA you could buy the firearm if it is on the certified list or if it is PPT, but you can not buy the magazines unless you are exempt.

Keep the mags, you'll wish you did someday.

Whatever you do, please don't sell the gun out-of state or sell/consign the gun to someone who will sell it out-of-state. If you do, it cannot be resold to a CA resident (except LEO) and it is gone for good.

I personally refuse to sell any gun to anyone out of state. Too many nice guns leave CA and can never come back which limits the selection available to all of us. No doubt, the gun control lobby set up the CA gun laws to accomplish just this. Plus, it's my way of lifting the finger to all those a**holes on Gunbroker that say "will not sell to CA".

The gun control lobby can't take our firearms away lawfully so they severely limit the availability. It's called attrition...... less guns are available every year and eventually we will only be able to purchase a handful of models in CA.

The right of the citizens to keep and bear arms has justly been considered as the palladium of the liberties of a republic; since it offers a strong moral check against usurpation and arbitrary power of rulers; and will generally, even if these are successful in the first instance, enable the people to resist and triumph over them."
