DROS 10 day... on 7,8,9,10 day denied possible?

Just curious has this ever happen to any anyone? Are you still in deep waters til the 10th day. Does it really take 10 days to do all the back round checks? Now if the DROS is denied well they call you right away or the FFL does? Thanks

In other words on what day of the 10 day hold your safe?

You are safe exactly 240hrs after submitting the DROS if there is not a delay or denial within that time.

If a DROS is delayed or denied, only the FFL is notified by the DOJ. Neither he or the DOJ needs to pro-actively notify you. If the FFL doesn't give you a courtesy call, you'll find out when you walk in to pickup your purchase. If it is a denial, you'll be given a POA form so that any firearms currently in your possession can be transfered out.

quick question, What if the dros is denied for the seller? Lets say he/she happens to not be the original owner of firearm being dros or has DMV issues or other issue causing dros to be delay or denied? Would you lose out on the money you paid to the seller?

Incorrect. I had an 11th day denial. The guy had already picked up the gun. I had him bring it back in.

Wow. If the customer refuses to bring it back, is it up to you or the DOJ to get the police involved? Wouldn't the police be required to take all his firearms?

I hope this never happens to me.

Right, if after 10days the firearm has already be released, it's up to the authorities to get it back. I sure wouldn't get involved, beyond provide the information on the DROS and 4473.

I called and told the dude and asked him to return it. We met in Bakersfield and he gave it to me. He was a Kern County Fire Captain! Mistaken identity. If he had refused, then I would have notified the Kern County Sheriffs and let them deal with it. It didn't need to go that way. He got it cleared up and came back later on.

so, i just filed the dros yesterday for a new handgun, just to find out today that there is a warrant out for my arrest because i did not pay a fine in time, for a non-traffic violation. my ca drivers license is still valid and has not been suspended..... is my dros going to be denied?

POA form? I don't recall ever giving a power of attorney form to anyone for being denied a firearm purchase. Since the reasons for being denied are so many such as simply owing money to DMV, incorrect information (what DMV has on file doesn't match what you put on DROS), or a hundred other reasons. Simply being denied a firearm purchase doesn't mean you automatically have to give up all your firearms. It's not your FFL's responsibility to facilitate the taking of your guns either. That is strictly the job of the court system and law enforcement.

Best advice is to go take care of the warrant ASAP...I won't say you will absolutely get a denial, or even a delay, but in the event you do get denied your FFL will give you contact information for DOJ. When you call them you can say you took care of it and fax them a copy of the court record. If you're denied you will have to pay another $25 for a new DROS fee.

I think the seller part applies to handguns. Long arms aren't kept in records? right? wrong?

The seller part only applies on either long gun or handgun PPTs. All other transactions, the seller is unknown since it is a dealer transfer. Only in a PPT will they run the seller if after the buyer is denied.
