    1st DROS Rejection

    So I had my first customer get rejected from DROS due to some DMV issues.

    My question:
    Do I need to do a new 4473 for them after they've fixed their DMV issues and I re-run the DROS? Or can I cross out the one I wrote in in section B since it doesn't need to be there until the transfer is completed? I was assuming I'll mark the box that said NICS (in our case DROS) was denied, but then wasn't quite sure if I needed to do a new form or not.

    I'm guessing I'd just do a new 4473 that would associate to the new DROS, correct?

    I find it easier to just do a new 4473.

      I just do new 4473s and keep the rejections together. Technically that is probably correct.

        Yes, I do believe denied 4473 must be stored separately for the ATF.

            The only cancellations I've had have been initiated by me on DROSes; so, I haven't kept the 4473 separated with the denials. I didn't even permanently file it because no transaction was occurring. If the DOJ (or NICS somehow) initiated the cancellation, I'd definately keep it with the denials. Don't really know if that is wrong or not.

              I had a dros reject on a 30 day handgun violation. I put the notice with the original dros and 4473 and they are in a folder all by themselves but if I have another rejection or violation I think I'll keep them together. Hopefully there won't be too many. Don't know if that's correct but as Wes said, it was not a completed transaction so it would not seem like it should be filed with your completed dros's or 4473's.

              I ran a new dros and did a new 4473 after the 30 days were past. Essentially a new transaction. Buyer was confused on the date of a previous purchase from another FFL. Cost him another 25.00 and another 10 days.

              Again, just my take without any verification from BOF or ATF.

                With My FFL I had three types of paperwork and kept them separate...

                1 for the regular, cleared and registered firearms

                2 for the denied (oh you also need to fax a copy to your local PD in most counties)

                3 for the canceled.

                Per my ATF inspector, you also have to write or stamp in big letters CANCELED and DENIED on the 4473 if it's appropriate.

                When I had my ATF audit it was simple and I knew where to go and make it easy for the inspector.
