    FFL07 Warranty Work Question

    What would the BATFE tell a FFL 07 in Texas regarding their ability of receiving a rifle for warranty repairs from a customer in CA to their location in TX but not being able to ship it back to the customer(non-FFL) in CA directly? Would the FFL 07 in TX be required to follow the California Firearms Licensee Check (CFLC) Program? I thought the program was only for shipping/transfer of weapons to CA FFL's?

    federal law allows for the 07FFL to receive a firearm directly from a non-licensee, and return it directly back to the customer, without needing to use any FFLs. So, BATFE would just tell the 07 to make sure that they comply with CA law when doing so.

    And CA law allows for a non-licensee to ship a firearm directly to the FFL and have it returned directly, without having to use a local FFL. And if the FFL is shipping directly back to the customer, then the CFLC doesnt not apply.

    No. If you do not ship or transfer firearms to a California FFL, the CFLC program does not apply to you. If you decide to ship or transfer firearms to a California FFL in the future, you will be able to enroll in the CFLC Program at that time.

      ke6guj - That is what I thought and I found that same section you posted from CA DOJ FAQ webpage... The FFL 07 told me that the BATFE told them that they cant ship anything directly back to a customer in CA because of some "list"... here is a direct quote -
      There is an approved manufacturers list (or some such thing) that all firearms manufacturers must be on in order to ship to California, and we are not on it.
      At 1st I thought the FFL was talking about the banned list of weapons but the above sounds like the CFLC program. I am starting to think that the FFL just doesnt want to play the "game" with DOJ... Hopefully I'll get some clarification tomorrow from my contact with this FFL.
