    Fees - So Confused

    Can someone school me in Private party transfer fees in various scenarios? I haven't bought or sold a firearm in 20 years and searching has only confused me.

    So, if was consider a long arm, private party transfer the fees are:

    FTF:
    $25 dros + $10 fee -- This is law correct, you can't charge more? The buyer pays this or both parties?


    If I ship through a FFL to a FFL?
    FFL Fee + Shipping? As the seller I would have to pay my FFL fee + shipping, then the buyer would have to pay his FFL fees and shipping? What are the range of fees and shipping cost (8lb rifle). This seems expensive, why would I want (or need) to do it?


    Can I ship direct to the buyers FFL? I just pay shipping? Buyer pays his FFL fees?

    Thanks for the help. I think I need to start looking for property in NV or OR.

    FTF PPT, $25 DROS and the FFL may charge UP TO $10, so $35 is the limit.
    You may find an FFL here or there willing to do it for $5 or even free, but don't count on it.
    Fees may be paid by buyer or seller... doesn't matter as long as it's paid. Some sellers offer to pay the transfer fee as a way of sweetening the deal, but honestly, it's no different from reducing the price by $35.

    Transfer, $25 DROS plus whatever the FFL wants to charge for a transfer fee. Some places charge $10, some charge $150.
    The FFL fee is taxable if the sale itself is taxable.


    Legally, you can ship directly to an FFL, however, some FFLS will not accept shipments from non-FFLs... you'll have to contact them first.
    FFL to FFL, there is no FFL fee from the shipping FFL other than what he's going to charge to ship the item out.

      Just a bit of additional info regarding sales tax:

      Sales tax needs to be collected on firearms which come from a business. If it comes from a private party, is an occasional sale and the person does not have a business, then sales tax does not have to be collected, but a letter should be written to document it.

        Thanks guys. I called the buyer's FFL today to make sure I had everything he needed, and he was willing to receive the rifle with a copy of my License. He said the buyer will have to pay tax on the sale price. Though he was admittedly rusty on the subject of receiving a shipped firearm from a private party.

        I guess at that point the buyer and FFL can work it out

          There is really nothing much that needs to be done with receiving a firearm from a non-FFL. The DOJ letter does not apply. A copy of the seller's DL is nice to document where it came from.

          If the seller is a private party, it is an occasional sale and does not have a business, then no sales tax is collected if you document this by means of a letter.

              I just did this yesterday, purchased via PPT. I went to Turner's and did the DROS there, and the total was $35 ($19 DOJ DROS fee, $1 DOJ Safety fee, $5 DOJ Eq fee, and $10 PPT fee). I called up 5 different Turner's stores closest to me to make sure on the PPT fees, and they were all the same. So if all else fails, you can go to a Turner's as they're open 7 days a week and only charge $35 for PPT.

                Ok I'm a little confused by this. I want to clarify that I understand. a FTF transfer the max price is $35. but if you have a weapon shipped in then they charge you the $25 plus whatever they want so the $35 max no longer applies. Is this correct?

                    Correct.
                    That is an FFL transfer. Fees can range from $5 to over $100.
                    A local chain store gets $125 (plus DROS), and they probably tack their $5 dealer fee onto that too.
                    OC Armory gets $35 for a stripped lower ($10 each for additional lowers from the same shipping source), $45 for a pistol, and $55 for a long gun (plus $25).
                    Bright Spot Pawn gets a flat $35 (plus $25).
                    OC Indoor gets the lesser of 15% of the purchase price or $50 (plus $25).

                    The FFL may or may not charge sales tax. If he does, the entire amount is taxable. If he does not, you are obligated to report the purchase on your state income tax return.

                      well then in this case I just had another shady dealing with the gun room in elk grove. I just did a FTF there and they charged me $36. I'm not concerned about the $1 but if they law states a max $35 fee how do they get off charging that extra $1. i guess its like the last time I caught them being shady ... they said we can charge whatever we want.

                          That is complete BS. They obviously know the law and are purposefully flaunting it, thinking that nobody will report them for $1.

                            Its dumb on their part .. why mess around for a lousy $1? I will report them when my pistol gets out of their jail. I would guess I report them to DOJ?

                            FYI people in the South Sac area. below are the charges the FFL charges for dealer transfers as of 3/16/2010. Again these are dealer transfers (when you buy a pistol and have to have it shipped in). All prices are plus DROS of $25

                            Gun Room $100
                            Wild Bills $75
                            River City Gun $75 ... I was told it would be higher if on a gun they sell.
                            Wild Sports ... does not do dealer transfers ... only FTF transfers

                              The $1 might be sales tax. Some places might make a mistake and charge sales tax on the FFL fee, but there is no sales tax since a PPT firearm is sales tax exempt.
