    NON FFL XFER TO FFL01

    I won a C&R long gun on Gunbroker.
    The rifle is being sold to me by a non FFL holder in Indiana.
    Seller wants my FFL dealer to mail him (seller) a copy of dealer's FFL.
    The dealer who I go through (FFL01 holder) refuses to mail a copy of his FFL to the Indiana guy, claiming that it is not necessary and that there is the possibility of his FFL being used illegally at a later date.
    The guy in Indiana will not budge.
    What do I do? I've already paid him.

    A) You can keep trying to convince the seller to ship it without a copy of your local FFL's license. Did you show him where he can verify your FFL's license on the BATFE ezcheck website?



    B) You can try to find another local dealer who doesn't mind mailing out a copy of his FFL to an unlicensed buyer. They do exist.

    C) You can apply for a C&R FFL for yourself and see if the seller will hold the gun for you for a couple of months until your C&R FFL shows up.

    4) You can ask the seller for a refund.

      Here is an ATF newsletter.



      Note it says only licensed persons must verify.

      So if the sender used the FFL EZ check system, that would be considered valid.

      Finally you could contact the ATF and find someone that can verify that info and give the sender that phone number and have them call to confirm.

        You can contact Bright Spot Pawn in Riverside. They do transfers all the time and their fees are reasonable. They're off the I-15 & SR-60. A little bit of a drive but worth it.

          The BATF suggests not giving out a copy of a FFL to a non-FFL, so your local FFL is being reasonable and following the law, as well as reasonable procedures.

          As stated, the seller can confirm this with the BATF and can confirm the FFL on the ezcheck web page.

          The seller needs to either ship it or refund your money.

            Thank you everyone for the sound advice. One other problem that is being hinted at by the seller is his reluctance to deal with CA. I wish that he had simply said "no sales to CA" when he put the rifle up for auction. He has offered to return my money.

            UPDATE: The seller got ahold of the BATFE and has seen the light. He put my rifle in the mail this morning. Thanks again, everyone.
