Missing POR - How screwed am I?

So I was auditing my own paperwork and for a recent handgun transfer I forgot to get POR from the buyer. I'm trying to get in contact with him now to have him fax, email, or snail mail me a copy of an appropriate document.

My question is, what happens if the guy just ignores my phone calls and emails? This is the only transaction out of the 100+ I've done so far where I'm missing any paperwork.

Can I threaten the buyer with the transaction being invalid and that his weapon will be confiscated if he doesn't get me the required documentation? Or would I just be full of crap?

I don't know if he's going to totally ignore me, but I want to figure out what my options are if he does.

DO NOT THREATEN THE CUSTOMER WITH ANYTHING IN ANYWAY! To be blunt, you screwed up, not the customer. It is our duty to make sure everything is done correctly, not the customers's. So you are unfortunately at his mercy.

If you tried to give me that line, here is exactly how it would go down.

Ugimports: Your transaction is invalid and your firearm will be confiscated unless you get me your POR.

Me: LOL! Actually, I supplied you with my POR and you must have lost it. You are in violation and I will be calling the ATF and the DOJ to notify them that your transaction records are out of compliance. The only person losing some guns will be you when you are taken out of business for not having the proper documentation before releasing a firearm, which I believe I did leave with you and you are just too incompetent to properly retain records. Which also gives me pause because are my documents secure at your business? What other information of mine have you allowed to be lost and compromise my identity? You will be hearing from not only the alphabet agencies, but my lawyer as well. Have a good day. *click*

As was stated, it is better to catch flies with honey than vinegar. Try and bribe him to take time out of his day to do the work you should have gotten right the first time. A free box of ammo. You will come to him. You are at his mercy.

Do not turn into one of those gun shops that threatens and tries to intimidate your customers because of your mistake.

In the grand scheme of things, if that is the worst thing the ATF or DOJ writes you up for, you are doing ok. Try for perfection, but reality is sometimes things are going to slip through. Do your best to fix them, but I would advise you never to get testy with your customers over it.

You might want to consider making a check list so that you don't forget something like that again. I find it helpful, especially if I am rushed, but you need to only check it off if you have already done it, not before you have because you intend to do it next.

I had a similar situation happen. After my phone calls and e-mails went unanswered I sent a certified letter to the buyer requesting the info and I kept a copy of that attempt with my records of the sale. The inspector said my honest effort to correct the inadvertant error was good enough.

No, you can manually enter the CDL # and details if you don't have a reader unit. I'm just guessing, but if you "ran" the CDL via the reader and it was downloaded to DOJ, it would show that you at least electronically verified residency...at least IMHO.

That does you zero good. The address doesn't match the DL or he sold a handgun. In the case of the handgun, the DOJ might not care that you tried to fix your mistake and they might write you up anyway. For the feds you can always leave that blank and hope they don't find it or you can remember you did look at his vehicle registration and write that down since it is not required you take a copy for the 4473.

You have to try to run the DL through the card reader. If it does not work, then you can manually enter the information. You then need to keep a copy of the drivers license.

If you submit DROS where you do not have a card reader, you need to run it through the card reader when they come back to pick up the firearm and save the information in a file.

The bottom line is that you ALWAYS have to try to read the DL through the card reader, there is no excuse for not doing so, even if the card reader is broken. You have to try.
