When are LEO Roster Exempt?

    When are LEO Roster Exempt?

    Does it only apply if they are purchasing a firearm for duty use? Or does it apply for any purchase they make when they furnish their LEO credentials for exemption when doing DROS?

    Policy Change Regarding State Exemptions for Authorized Peace Officers
    Effective immediately, peace officers who have legislative authority to carry and use firearms may, without a letter signed by the head of their agency or the agency head's designee, purchase non-rostered handguns and/or large capacity magazines. The peace officer must present a valid peace officer identification card and the dealer must retain a copy of the identification card on file. (PC 12132 & 12133). A letter is still required from the head of the agency to exempt the peace officer from the ten day waiting period. (PC 12078).

          Yeah, I think I was confusing the roster with the 10 day wait which is why I was thinking they might have needed paperwork. So to summarize what's in ke6guj's post:

          Roster: Always Exempt - when presenting LEO ID to keep a copy of

            You got it. Most of the time I wait the 10 days because it takes 14 days to get a letter signed, hahaha.

              Does this apply to any full-time, paid government law enforcement or only California "peace officers?"

              There are many classifications of "Law Enforcement Officers" who are not "peace officers" (under sec. 830.1 et sec of the California Penal Code) even though they work full time for a government (state, fed, local) agency. They're cops including those with "peace officer" powers of arrest while on duty, etc. These are uniformed, gun toting, government lawmen but not peace officers. Also what about reserve, auxiliary or special deputies/officers who have peace officer powers while working but none when off duty?

              The form refers to "Peace Officer" exemption, but some LEO's have job classifications of ranger, campus police officer, special deputy, police officer (specialized agency), airport police officer, railroad police, AMTRAK police, various federal uniformed services (US Mint Police, US Park Police, US Protective Service/Homeland Security, military base civilian contract or DOD police, etc.).

              This is in relation to acquiring non-rostered pistols.

                Yes. On my DROS the box that says 'Transaction Type' it's typed: Non-Roster Peace Officer, Exemption Type: 30 DAY MULTIPLE PURCHASE EXEMPTION 10 day wait with no letter head. I'm not an FFL, I just made another purchase from a LE FFL in San Jose.

                  It's any peace officer - from FBI to Corrections to Arson Investigators (if they qualify under CA PC as such. Some do, but not all).

                  **Note: It is a crime to copy a Federal LEO ID. If the buyer doesn't know this, you should. Politely ask for letterhead verifying employment.

                    My question is based on California Penal Code Sections 830.7 and 830.8. Both these sections describe law enforcement officers (including federal agents) who ARE NOT "PEACE OFFICERS" but have peace officer authority while on duty.

                    For example, 830.8(a) PC states: (a) Federal criminal investigators and law enforcement officers are not California peace officers, but may exercise the powers of arrest of a peace officer in any of the following circumstances:

                    If you copy a fed ID just mark COPY boldly and repeatedly on your copy. A fuzzy Black and White photocopy marked up will not violate the spirit/letter of the law re. copying federal documents. Newer fed IDs have watermarks, microprinting, holograms and other safeguards as well to prevent counterfeiting. Besides, your intent is to make a verification copy to comply with a state government requirement.

                      A short answer is if the sworn LEO is authorized to carry on duty they are exempt from roster and 30-day wait. This includes Reserves. Still need the 10-day wait unless they have a dept. letter.
