Yesterday I called my FFL about receiving a gun I am thinking of buying from an out of state dealer. I was told that the DROS fee is $75.00 (OK with me) but I would also be responsible for paying the California sales tax on the price of the gun (not OK with me). Anybody know anything about this? Sales tax on this particular gun would be about $150.00. I am never charged sales tax on items I have shipped to myself from out of state (Amazon, Midway, etc.) so what is going on? Thanks for any help.

Sales Tax

Is the firearm coming from a private party or from a business? If it is coming from a private party and the person is willing to document that it is a private sale, an occasional sale and that they don't have a business, then sales tax is not to be collected. Otherwise it is.
The DROS fee is $25 and the FFL is not to claim otherwise. I assume that $50 is the FFL fee, but they should not combine it all and claim it is the DROS fee. It might just be a misunderstanding with what they said and what you are saying.
If you look at you CA income tax form, there is a line for paying sales tax. Just because most people don't do what they are required to do does not make it legal.
