    PPT Buyer and Seller Must Be Present?

    Has anything changed. In my experience, the FFL required both buyer and seller present at time of transaction. I?m selling a firearm and a potential buyer is saying that he will go in and start the paperwork and give the FFL the cash. I come in later with my firearm and do my part of the paperwork and FFL gives me the cash. is this correct?

    It's possible, but if I'm the FFL I don't touch the money. You'd have to ask how the particular FFL you're going to handles it. Both buyer and seller do NOT need to be present at the same time. I've done several transactions where buyer/seller knew each other and seller dropped off firearm a day or two ahead of when buyer could make it. I never get involved with their money and I still have the buyer inspect the firearm before they start DROS.

    Depending how far you are going it would suck if the FFL didn't know what you were talking about when you asked for the cash before handing over the firearm.

        This is feasible. Maybe not exactly legal, but it would be up to the FFL. Basically the FFL would be getting all of their information, but not starting the DROS. Then you come in, they start the DROS, you sign, and you leave. Then the buyer comes in whenever to sign their portion.

        I would call the FFL and make sure this is okay with them. If they say no problem, then go for it. I would make it clear with the buyer no refunds for any reason. If the buyer is denied, the gun goes back to you, but no refunds. Let them know your time is valuable and once the money is yours, you will not be able to refund it.

          Might want to check with your rep on that one....that's a no-go...you won't have a signature and thumbprint from buyer on DROS contemporaneous to running it for them to affirm the information.

            What do you mean? Have you ever used the DROS worksheet or done a DROS when there has been no internet? You capture everything and then submit the electronic transaction when you're able to. The 10 day doesn't start until the electronic submission occurs.

            So the FFL theoretically could do this:
            1) Buyer comes in and completes all their information on a DROS worksheet (including a thumbprint)
            2) Seller comes in, gets paid, and supplies all of their information on said DROS worksheet
            3) FFL submits DES transaction and optionally collect seller's info for electronic (or not similar to consignment where it's only on DROS worksheet)
            4) Buyer comes in signs off on all the electronic stuff + pickup thumbprint when they come back to pick up.

              The only paperwork that could get started without the gun being present would be the buyers info on the 4473, or am I missing something?

              I'm not really seeing any advantage to the buyer here. I think that if the dealer becomes an active participant in the sale, wouldn't that cause sales tax to be collected? Seems like a foolish plan, but what the hell do I know.

                I guess I am the only one that still uses the DROS worksheet for transactions from time to time. I agree sales tax may need to be collected but that is on the FFL and buyer. Seller should still get their cut

                Also, advantage for buyer could be they are about to be out of town and want 10 day up when they get back. Perhaps this is only time seller can make schedules work? They may not care to DROS sight unseen. In all the 16 years I have been doing this I have not seen a single PPT buyer reject a firearm at DROS time. Doesn't mean it can't happen but if this buyer has had same experience it may be why they are comfortable with no inspection.

                  Meh. As long as everything is complete when they come in to audit, no one knows or cares.
