    FFL advice needed,please/ All OK

    Recently purchased a non rostered handgun from out of state FFL. Correction,I?ve used the term ? roster? incorrectly. The gun is a Colt Single Action Army,(that for me is high ticket at 3K), hence my concern. Gun was shipped Mar 8 via USPS,delivery was attempted on Monday 11,shop is closed.
    Gun was delivered Tuesday 12 and signed/initialed about 1100. I contacted shop on Wednesday via email with track info to make inquiry. FFL response is he does not have gun and proceeds to tell me that shipping with FedEx and UPS is the only way to go for various reasons of USPS problems. FFL says he will be on lookout. I lived in OC for five years and my FFL there,used to ship/ receive
    handguns via USPS and never heard of any issues. Can anyone advise me how to proceed going forward?In 50 years of gun trading,I?ve never had a gun lost,stolen only one gun damaged(an M1 Garand that UPS broke the stock). Thanks for any assistance.

    I would take a copy of the proof of delivery into the shop in person...

    Speak to the manager or owner. If you have proof that the gun was delivered and was signed for, not much they can say.

      ABSOLUTELY take the proof of delivery and speak with owner, etc...!
      American soldier by choice. Made in America by the Grace of God.

      So, now it is ironic that the State whittles away at the right of its citizens to defend themselves from the possible oppression of their State.

        If it shows delivered, then it is on the receiving FFL. How did you pay the shipping FFL? If my credit card, you could always tell the shipping FFL that you will be doing a chargeback and the shipping FFL needs to figure it out since you never received the merchandise. However, as a shipping FFL, I would show you the signature and tell you that it is not my problem. So back to telling the receiving FFL they have 24 hours to find it then you are reporting it stolen to their local law enforcement.

            As long as the barrel length on the Colt Single Action Army revolver is 3" or greater, then it is an exempt handgun.

            Dimensionally compliant (minimum 3" barrel length + minimum 7.5" overall length + minimum 5 round cylinder) single-action revolvers are exempt from CA unsafe handgun laws. [PC 32100(a)]



            Penal Code 32100
            (a) Article 4 (commencing with Section 31900) and Article 5 (commencing with Section 32000) shall not apply to a single-action revolver that has at least a five-cartridge capacity with a barrel length of not less than three inches, and meets any of the following specifications:
            (1) Was originally manufactured prior to 1900 and is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations.
            (2) Has an overall length measured parallel to the barrel of at least seven and one-half inches when the handle, frame or receiver, and barrel are assembled.
            (3) Has an overall length measured parallel to the barrel of at least seven and one-half inches when the handle, frame or receiver, and barrel are assembled and that is currently approved for importation into the United States pursuant to the provisions of paragraph (3) of subsection (d) of Section 925 of Title 18 of the United States Code.

              Shipping ffl or seller has to file claim. You do not own firearm. I purrhased high w=end o/u and had shipped from FFL to Oaktree and never arrived from UPS. Showed out for delivery from ups in Sylmar. I tried to file claim and could not. Shipping ffl filed claim and I got my money back . Your FFL is reponsible for claim. They logged onto thier books and shipped item in their control which is now possibly stolen/ missing.

                Turned out all OK. FFL found and DROS is underway. Thanks for help.
