    AKM Barreled Receivers/Furniture Ready Kits Legal to DROS in California?

    Hello all,

    Apologies in advance if I am posting in the wrong forum.

    Here is my current issue: I would like to purchase an AKM Barreled Receiver Kit/Furniture Ready Kit as a lot of AKM rifles are out of stock. I have spoken to three different FFL's in my area and received three different answers as to whether or not they would handle the transfer of said receivers/kits. I was told by the first FFL that they haven't had such a situation come up and therefore could not provide a solid answer. Second FFL said the transfer most likely would not go through. Lastly the third FFL I spoke with said they don't see why they couldn't DROS said Receivers/Kits. That being said are there any California FFL's that have successfully DROS'd AKM Barreled Receivers/Furniture Ready Kits that will currently do so in or around the San Joaquin County Area?

    It depends on how it is configured/assembled.

    Because of CA assault weapons laws for other firearms that are not pistols, rifles, or shotguns that went info effect in 2020.

    A fully assembled barreled action on an AK receiver (no furniture installed) meets the CA definition of an assault weapon due to it being a semi-auto other with restricted features. [PC 30515(a)(9),(10),(11)]

    In order to be CA legal, before it is imported/shipped to CA, it must be rendered non-functional by removing parts to make it a stripped barreled receiver.

    A stripped barreled AK receiver (no bolt-carrier group and no fire control group installed) is a CA legal configuration that can be legally transferred by a CA FFL dealer.
    ^ATF 4473'd as "other" and CA DROS'd as "long gun, other, receiver".




    Penal Code 30515
    (a) Notwithstanding Section 30510, "assault weapon" also means any of the following:
    (9) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that does not have a fixed magazine, but that has any one of the following:
    (A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
    (B) A thumbhole stock.
    (C) A folding or telescoping stock.
    (D) A grenade launcher or flare launcher.
    (E) A flash suppressor.
    (F) A forward pistol grip.
    (G) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
    (H) A second handgrip.
    (I) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning the bearer?s hand, except a slide that encloses the barrel.
    (J) The capacity to accept a detachable magazine at some location outside of the pistol grip.
    (10) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that has a fixed magazine with the capacity to accept more than 10 rounds.
    (11) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that has an overall length of less than 30 inches.
