    FFL03 and CMP

    Question #1 - If my friend has an FFL03 and COE, can I purchase a Garand from CMP and have it shipped to my friend for transfer to me?

    Question #2 - If my friend has an FFL03 and COE, can HE purchase a Garand from CMP and have it shipped to himself?

    I've been doing a little research and opinions seem to differ across several different sites. Any input would be a appreciated. Bacon is not an option on this one.

      Legally, doing what is asked will cause everyone involved to catch a Federal felony.


      Under Federal laws...

      A 03-FFL is a collector and, legally, can only obtain C&R firearms for their own collection.

      A 03-FFL acquiring C&R firearms for a third party violates Federal laws causing the 03-FFL holder to be considered an illegal firearms dealer.

          As to question 2, that has been a hot topic on these forums from time to time. I think the law says he can't. He can go out of state and acquire a C&R, including a CMP Garand, and then bring it back to CA. But he can't legally have one mailed to him.

          Having said that, I know that CMP will ship rifles to a C&R + COE holder in CA, and I know that DOJ will accept the report of acquisition form that a C&R holder is suppose to submit when acquiring a C&R out of state.

          How or why this happens I cannot explain.

          The question you didn't directly ask but suspect you are wondering is "If friend acquires one from CMP, can he turn around and sell it to you"? As Quite points out, the legal answer is no. A collector can buy and sell C&Rs to improve their collection, not to broker sales. Would you/he get caught? Hard to say. But seriously, is any of that worth the risk? Buy one from CMP and have it shipped to a local FFL. A lot less hassle, definitely legal, and should not add that much to the cost of the rifle.
