    Real FFL question

    Question:

    I have an FFL03 / COE. I'm looking at buying a "modern" handgun (S&W 36) as a private party transfer. The serial number on the revolver indicates it was manufactured in 1969-1970. This would make it 53 years old and a C&R.
    Can I just purchase it through the normal firearms process, or am I required to present my documents and declare that I am an FFL03 / COE holder at the time of purchase. There doesn't really appear to be any advantage to acquiring a handgun as a C&R using an FFL / COE - an old rifle I can see it
    I got the license mostly for out of state ammunition purchases and this would be my first experience with a C&R purchase, other than logging it in my book, I have no clue how to proceed.

    Guidance would be greatly appreciated.

    A transfer of a C&R handgun must be done through a CA FFL dealer.

    When acquiring a C&R firearm from a CA FFL dealer, a person with a valid C&R 03-FFL and valid COE is exempt from the following:
    1. The 10 day wait. [PC 26970]
    2. The 1 in 30 day wait. [PC 27535(b)(9)]
    3. The FSC requirement. [PC 31700(a)(6)]
    4. The safe handling demonstration requirement. [PC 26850(h) and 26860(g)]
    In addition, those documents (C&R 03-FFL and COE) also serve as proof of residency. [PC 26845(b) and 11 CCR 4045(d)(1)]

    If you do not present your info (valid C&R 03-FFL and valid COE), then the CA FFL dealer can not legally utilize those exemptions for your transfer of a C&R handgun.
    Therefore... You will have to do the 10 day wait, 1 in 30 day wait, need a valid FSC, need to do the safe handling demonstration, and need a valid proof of residency; when you go to acquire the C&R handgun through a CA FFL dealer.

      Thank you Quiet for the information. The gun in question is almost 100 miles away, but I really want it for my collection. Being able to make one trip to PPT and take it home with me is a real bonus and saves that second 200 mile round trip 10 days later to pick it up.

        Seems like most FFLs these days know how and are willing to do these exemptions but if you are traveling 100 miles for this, I'd call and make sure.

            If it's in California you will fill out 4473 and pay DROS fees, but with FFL03 and COE you should be able to walk out with it same day. I recently did this for a mod 36i picked up.

              The CA FFL dealer doing the transfer of the C&R firearm, needs to make copies of the transferee's valid C&R 03-FFL and valid COE as part of the transfer process to enable all the eligible exemptions.

              So, don't forget to bring your valid paperwork (C&R 03-FFL and COE) when you go to acquire a C&R firearm from a CA FFL dealer.

                Also remember you are still required to enter the pistol in your bound book, as it's a C&R which you acquired while you are a licensed collector.
