    FFLs: Is this transferable?

    Looking at the item below:

    I can't help but wonder if this is transferable. Is it treated like a barreled action, or is it something else since the BCG is included? It's not over 30" long in this configuration, so if it's not a barreled action I guess it's an AW? If anyone could chime in that would be great, since I wouldn't mind picking one up.

    It meets CA's definition of an assault weapon due to being a semi-auto centerfire firearm that is not a pistol, rifle, or shotgun and having restricted features and not meeting the overall length requirements. [PC 30515(a)(9),(11)]

    In order to be CA legal...

    Option A.
    It is made into a rifle by installing a shoulder stock.
    After which, it needs to be checked so that it does not have any restricted features and it needs to have an overall length of 30" or greater.

    Option B.
    It is made into a rifle by installing a shoulder stock.
    After which, a fixed 10 or less round magazine is installed so that it can legally have restricted features and it needs to have an overall length of 30" or greater.

    Option C.
    It needs to have a fixed 10 or less round magazine and an overall length of 30" or greater.

    Option D.
    The bolt-carrier group is removed from the firearm or the fire control group is removed from the firearm and shipped separately.
    ^This is so that it is considered a non-semi-auto barreled receiver.

    Due to previous CA cases...
    If the bolt-carrier group is removed and kept with the firearm, then it can be considered a "broken assault weapon".
    In addition, if the bolt-carrier group is removed and kept with the firearm and no parts needed to make the firearm CA legal are with them; then it can also be considered an "attempt to make and possess an assault weapon".



    Penal Code 30515
    (a) Notwithstanding Section 30510, "assault weapon" also means any of the following:
    (1) A semiautomatic, centerfire rifle that does not have a fixed magazine but has any one of the following:
    (A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
    (B) A thumbhole stock.
    (C) A folding or telescoping stock.
    (D) A grenade launcher or flare launcher.
    (E) A flash suppressor.
    (F) A forward pistol grip.
    (2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
    (3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.
    (9) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that does not have a fixed magazine, but that has any one of the following:
    (A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
    (B) A thumbhole stock.
    (C) A folding or telescoping stock.
    (D) A grenade launcher or flare launcher.
    (E) A flash suppressor.
    (F) A forward pistol grip.
    (G) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
    (H) A second handgrip.
    (I) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning the bearer's hand, except a slide that encloses the barrel.
    (J) The capacity to accept a detachable magazine at some location outside of the pistol grip.
    (10) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that has a fixed magazine with the capacity to accept more than 10 rounds.
    (11) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that has an overall length of less than 30 inches.

      All it needs is a buttstock to be legal. It's too bad they don't have any cheap M70 buttstocks to sell you with the gun, they would probably install it for you if they did.

          Ok, thanks for the heads up all. Perhaps i'll see if i can find a beater buttstock and send it to a middleman FFL for the install.
