    DOJ Long Gun Denial

    On October 21st 2002 I plead guilty to Penal Code Section 240 {simple assault}. I contacted Don Kilmer in 2012 to see if he could help restore my rights. He advised me to apply for a personal firearm eligibility check through the DOJ. I completed this and found out I was not a prohibited person apparently since 10 years had past with no other incidents. Since then I have purchased several long guns and handguns with no problems. The last transfer was approved February 17, 2020. I won a shotgun in March this year through the NWTF benefit dinner. An was just informed the DOJ denied the transfer based on the incident from 2002. I have not had a single instance of trouble with law enforcement since 2002. Can anyone help to lead me in the right direction to remedy this?

    Talk to attorney or do another pfec and see results.

      Who was the other person in relation to you ?

      You may be getting denied by the fed's if it could fall under any sort of DV

      a few years back the fed's changed it from 10 years (like CA) to a perma ban for any DV

        No relation. I'm trying to get any help or info before calling the DOJ.

          How exactly were you informed of the denial and that it was because of the 2002 incident?

              I was called by the FFL doing the transfer and was told it was denied and the DOJ does not tell him why. Later that day local law enforcement called me and said it was because of the 20 year old incident. I'm still waiting on written info from the DOJ.

                The notice you will (hopefully) receive from DOJ does not give any explanation as to why you were denied. The letter does provide a number to call to get further information as to the denial.

                    I would prepare myself for the DOJ showing up at my door to confinscate all your guns. They think your a prohibited person, they know you have other guns, and your now on their radar trying to buy another gun. CA DOJ has a whole taskforce dedicated to removing guns from ineligable people. Get your ducks in a row and don't have anything iffy in your posession. Hopefully you can get this sorted out quickly.

                      We're at the end of the UC Academic Quarter. This is the time that we always see a lot of posts like this.

                      They all seem to have the following qualities:
                      1) New posters

                      2) Extremely generic postings, and often lacking the context expected of knowledgeable gun owners

                      3) When "called out" on the generic nature of the postings, the OP will generally add new information, but also where that new information changes the proper response to the question.

                      4) At the end of the thread, we usually see a polite thanks and sign-off from the OP

                      When dealing with these threads, let's all stay professional and factual. It can be kinda fun to "Play Along" and maybe we're helping folks to get some extra credit points in class. But don't take the game too seriously.

                      This will all change with summer recess.

                          It is very strange, but who else would know about his history?

                          The thing to do now is file the appeal when you get the DOJ paperwork. Also maybe contact Adam Richards at RWS

                            The only way LE called you is because the store called LE. I?ve heard of some stores doing that after denials.

                            The DOJ sends a letter to the local LE but that letter takes weeks to get to them.

                              It may be ATF who alerted local LE. Maybe the Biden ATF is getting more aggressive with reporting denials.

                              OP you need to also file a NICS appeal. You also need to get your FBI rap sheet and review it and dispute any inaccuracies or incomplete dispositions.

                              You may also want to apply for a NICS voluntary appeal file, which will really help you if you ever get out of this God forsaken state.
