Question about long gun paperwork requirements

I've got a Marlin 39A shipping from Buds to an FFL holder down here, and I'm wondering if there have been any changes in the law since I last purchased a long gun in CA (roughly six months ago). The FFL would like me to provide "proof of residency," something that the retail store I bought my last long gun from didn't ask for. Driver's License was good enough for them.

I'm hoping that my selective service registration card will suffice (it has my current address on it), because my car is still WA registered and even though I pay some of the bills here they are all in my wife's name (yay for being a newlywed). Am I screwed? I didn't think there was any state mandate to provide this information for a long gun. I'd appreciate your help!

CA law says all you need is a CA DL/ID for a long gun, no specific POR needed. Federal law says that the address on your ID must be correct, or you will need to provide POR.

That's what I thought. Is a business owner/FFL free to add any additional requirements that he or she wishes, or is this an area where they have to follow the letter of the law?

In this case, I think an FFL can required additional requirements if they wish. It isn't like a PPT where they are required to facilitate the transfer. In this case, they could refuse to transfer your firearm if they felt like it, so you do have to play by their rules.

Sounds like you need to talk to the FFL and find out what POR he will accept. Since it is apparantly his policy to require POR for long guns, it would be up to his what POR he would accept. You could ask him why he needs POR when CA does not require it for long gun transfers.

Will do. Thankfully if it's going to be an issue I can just have my wife come along and DROS the thing. It's a gift for her anyway.

Since it is a gift for your wife, you should really have her DROS it.

Proof of residency is only required for handguns, but dealers can have additional requirements. It still amazes me that a CA Drivers License is not proof enough.
