    Help Finding an FFL

    Hi all,

I am not a CA resident any longer, but have an old family friend that is. He has what is deemed an "assault weapon" by CA "law." He has owned it since the 80's and got the letter in the 90's about its "registration."

I am wanting to purchase said firearm from him, but he cannot find an FFL in his area that is willing to transfer and ship it. At least one has told him to just put it in a box and "ship it" to my FFL, but don't tell them what's in the box!!!! I told him not to.

I live in AZ and have found several that are willing to accept it and transfer it to me.

He lives in Camrillo. I'm originally from Ventura, but left when I joined the service a long time ago. It saddens me that CA has gone so far down the hole on this constitutional right.

Any help would be greatly appreciated.

You do not need to have an FFL ship it. If your FFL will accept a shipment from an individual, he can send it himself. Either UPS or USPS priority mail.

Since an unregistered center fired "assault weapon" as defined by section 30510(a) is illegal in CA I'm not surprised any FFL would not touch it. If you can find an FFL who deals in such firearms perhaps they can help.
Your alternative is drive it out of CA. Shipping it would also be illegal unless by someone licensed to do so.

If it's a RAW than I don't really have anything, however if its not RAW but is deemed AW he may be better off making it featureless and then having an FFL ship it to you. He can then ship the scary parts to you himself.

          Alternative..

An alternative might be to separate the upper from the lower and send them separately. BUT...check with your local FFL first...

The AW appears to be pre-2000 and unregistered. If it is a "named" AW, separating the upper from the lower has no effect on the weapon's AW status.

That regulatory provision only applies to AWs within the scope of CA PEN 30515. "Named" AWs are covered under CA PEN 30310. Reference.

Neither UPS nor FedEx will accept firearm shipments from unlicensed individuals.

Based on the info he gave me, it is registered. He received that paperwork back in the 90's at some point.

I don't believe there is any way for him to make it featureless. It's a Tec 9.

I cannot find anything in the law, that I've been able to search, that would allow this.

Have him drive it to Arizona and ship it from there. Or meet you at an Arizona FFL to do the transfer.
Or find a FFL that has an assault weapons permit. Addax Tactical is probably the closest to him.

So there's a special "assault weapon" tag on certain FFL's in CA? Wow?

                        Thanks for the info.

There probably is not a law to allow a private individual to ship firearms. What is important is that there is no law preventing a private individual from shipping firearms. An individual may mail, USPS, any legal long gun to an FFL. An individual may ship any legal firearm via UPS to an FFL.

Private individuals ship firearms to FFLs on a regular basis for gunsmith or warranty work.

As of two days ago UPS will ship a handgun or long gun from an unlicensed individual.

There are specific laws about transporting and shipping Assault Weapons. If your not familiar with them, stop giving illegal advice. Straight from the horses mouth, note specifically # 9, #11, and #13 (c)

What are AK and AR-15 series weapons? What is considered a .50 BMG rifle under California law? Can assault weapons and .50 BMG rifles still be registered? I already paid the Dealer's Record of Sale (DROS) fee and went through a DOJ record check when I purchased the firearm. Does that satisfy the registration requirement?

The owner of the AW can ONLY have someone with an AW permit ship it, or drive it out of state himself. Once out of California, its just another gun, not subject to california laws.

Yes, only one with an Asssault Weapons permit can ship it. And they can charge whatever they want because the DOJ charges them every year for the permit based on how many AW's they handle. The more they handle, they more they pay. I would fully expect it to be several hundred dollars to ship it.
