Asking for a friend...
The Situation
A Glock was purchased and registered in California in 2020.
Questions:
A) What was the by the letter of the law process that should have been followed to transfer a firearm from Son to Father in this situation where both were residents of CA at the time?
B) What is the process for intra-family transfers for family members in different states? Is the recipient treated no differently than any other person (i.e. ship to FFL)?
Please let me know if these questions do not make sense. The friend is just trying to do the right thing and now incriminate his recently-retired father or himself.
The Situation
A Glock was purchased and registered in California in 2020.
- In December 2020, Glock 17 was 'given' to the Father by his son, the registered owner
- In January 2022, the Father moved to Nevada and is now a resident
- It is unclear if the Glock was transported during the move from CA to NV or if the Glock is still at the Father's vacation home in CA.
- (Correct or Incorrect)Transfer from Son to Father did not involve any paperwork or any FFL .
Questions:
A) What was the by the letter of the law process that should have been followed to transfer a firearm from Son to Father in this situation where both were residents of CA at the time?
A.1) Assuming A was followed, can the Glock be taken across state lines to NV if registered to a resident in CA (at the time) that is now a NV resident?
A.2) Assuming A was not followed, and Glock is still in CA, what is the process to transfer from Son to Father now that the Father is not a resident of CA?
A.3) Assuming A was not followed, and the Glock was transported to NV during the move, what is the process at this point? Or, does this now fall under NV jurisdiction?
B) What is the process for intra-family transfers for family members in different states? Is the recipient treated no differently than any other person (i.e. ship to FFL)?
Please let me know if these questions do not make sense. The friend is just trying to do the right thing and now incriminate his recently-retired father or himself.
