    Questions about Consignment

    Howdy. I have tried to get into the FFL only forum to no avail.

    I recently received my Secondhand Dealer Permit and was wondering a couple things about consignment.

    1) Are consignment guns exempt from the roster?

    2) Do I have to hold the gun for 30 days before I can sell it?

    3) How do I transfer a consignment gun? Is it under Dealer Sale or Exempt?

    4) What else can you tell me about this process that I should know?

    I typically just do transfers with the occasional sale now and then. I am a home FFL with limited access to wholesale outlets.

    Note, I am not a FFL. I have bought a lot of consignment guns.

    1) Yes
    2) Yes
    3) As a PPT. You need the seller to complete a DROS worksheet when they drop the gun off for consignment
    4) Consignments are also exempt from 1/30, same as PPT

      So, I have the seller complete the seller section of the worksheet and just attach it to the PPT DROS paperwork?

        Yes, I believe that is exactly what you do.

        Another thing to add to #4 on your list - consignments get charged sales tax

        Also, I have no idea how the bound book entries are done (or if they are done) for consignments.

            Log in from seller when received and out to buyer when sold. Any gun in your shop needs to be in your book. Do NOT forget to DROS acquire it.

            When you sell it, you use the PPT category which makes it 1-in-30 exempt. If the seller wants it back then you use consignment redemption.

              1. Usually, as long as you sell it as a PPT. If you plan to sell via Marketplace or Gunbroker you can't sell it in CA and ship it to the buyer's FFL.

              2. I hold the full 30, but you could start DROS on day 20 and not deliver until the full 30 has passed. I hold 30 'cause I don't want to get stuck with a denied DROS if it comes back as stolen. I have heard of cases where it clears the 30 day wait but then comes back as stolen on the DROS so it probably doesn't matter.

              3. Assuming you are selling it face to face as a PPT, you enter it as a Private Party Handgun Transfer.

              4. They may have fixed this, but when I got my SHD license, I did not get the screen Ronlglock showed. My screen only included "Buy". My DOJ rep told me the DROS side of DOJ doesn't talk with the SHD side of DOJ. You have to tell your rep you are a SHD and they will get your DROS status updated to include "Consignment". This is critical because if you enter it as a "Buy", its now your inventory and you cannot sell it as PPT. And since we're talking about an off roster handgun; you can't sell it in CA except to an exempt buyer. It has to be entered as a consignment to sell it as a PPT.

              I just learned this myself - you don't have to do a DROS worksheet if you enter it in the DROS acquisition system. The seller signs and thumbprints that form and it serves the same purpose as a DROS worksheet.

                This is completely false. All you need is the Consignment acquisition paperwork. There is no need to do a worksheet.
