    Dealer Acquisition Question

    I have a CA Dealer acquisition question. The requirements and recordkeeping for an acquisition of a CA legal firearm from a non-licensee coming to my place of business are clear, both Federal and State of CA. The requirements and recordkeeping if I, as a CA Dealer, travel to another state and wish to acquire a CA legal firearm from a non-licensee, are a little less clear. Maybe they are the same, just not sure, but I have received some conflicting input. Depending on the circumstances, I would either ship the acquisition to my FFL business address or transport it back myself.

    Do the requirements and recordkeeping differ in any way from a CA Dealer buying a CA legal firearm from an out-of-state non-licensee from an auction?

    Just want to understand the limitations, if any.

    I believe they are the same. I'm curious what others think.

    I have acquired firearms out of state from unlicensed individuals. I have never done a modern (non C&R) handgun, but I'm not sure it really matters. I have done modern long guns.

    I show my CDL and FFL to the seller and obtain a picture of his DL.

    I bring them back with me and enter them in my A&D book, and I enter them as acquisitions within the DROS system, waiting 30 days before I sell them. I have not had the occasion to ship them to my place of business but I'm confident I could do that as well. I've contemplated going to the Tulsa gun show and I'd either need to ship anything I'd bought, or try and include them in my checked luggage (following all TSA/Airline rules on that).

    There are others on this forum who have indicated you cannot acquire firearms out of state like that. They have well reasoned arguments on why they believe that is so.

    I know that Lock Stock and Barrel out of Simi Valley routinely advertises that they are doing out-of-state acquisition trips. They are a huge seller on Gunbroker. Being huge doesn't mean you know everything but I'd think with their volume if they were doing it wrong DOJ/ATF would have stopped them by now.

        Are you a member of the FFL Only Forum? If so, the issue was sort of discussed here:



        Re-reading that post I realize that I was probably mixing up "acquiring for resale" with "acquiring for consignment". This issue being discussed there had to do with the legality of acquiring firearms from out of state for consignment or pawn. My bad.
