What constitutes a new purchase?

Hey all you night owls!

I have a stump the star question. I recently purchased 2 pistols from out of state and both of them arrived at my FFL's place of business. I just filled out the paperwork for one pistol which I will be picking up in 10 days.

Now, when I go back to pick up the first pistol, can I pay my transfer fees and do paperwork on the second pistol?
--OR--
Must I wait 30 days from the date I did my previous transfer because that transfer would be considered a "new" purchase thus triggering the 30 day rule.

I was going to ask him but 6 people rushed the counter and my FFL got swamped.

It is one handgun every 30 days unless you qualify for an exemption. One exemption is having a C&R FFL and a CA certificate of eligibility. It can save you money is you purchase a lot since you would be able to transfer multiple handguns at once, saving $4 on each additional firearm. Also, longgun C&R can be shipped directly to you, saving all FFL fees. C&R handguns still have to go through a firearms dealer, but there is no waiting period.

Thanks. I am going to look into the exemption. It seems that most of my pistols are purchased out of state and I like to save money on taxes without jumping through all of the regulatory hoops. Even though it burns me up when I see a great firearm for sale or auction with the ubiquitous "NO SALES TO CALIFORNIA!"

Well, if you purchase a firearm out of state and it is from a business, you are required to pay sales tax on the firearm ( CA Sales Tax Firearms Information 495.0843 & 495.0848).

I have had customers buy from places which state no sales to CA. Often, it is pretty easy to talk them through the process and tell them if they don't ship to CA, then they are doing what the anti-gun people want. If it is a handgun not on the certified list or a longgun which is banned, then there is not much you can do. If you have a parent or child out of state, you can get any handgun (limited by count) by having them buy it (although it could be an issue since the 4473 asks if it for them) and then transfer it to you, filling out the proper forms or processing it as a family transfer.

If you come across a dealer who won't ship to CA, please let me know and I will see if I can get them to do it. No, you don't have to do the transfer through me, I just want to educate FFLs outside of CA so that the anti-gun people don't win.

I can give you the process of what a FFL would have to do and either you could forward it to them or I can give them a call. Calling tends to be best as then they can ask questions. It is also possible, if you are willing to pay more in shipping, to have the firearm shipped to a non-CA FFL and then have that FFL ship it to CA. If they ship a handgun using USPS, the extra shipping charge would be around $15, plus you would need to pay the FFL something.

If I own a not-legal-in-California-but-legal-everywhere-else gun, can I use it in California? I'm a CA resident but have a vacation house in Colorado.

If you are talking about an a-salt rifle, I would say no. There are restrictions on where a registered a-salt weapon can be used and if you get caught with an unregistered a-salt weapon in CA, you will have a nice legal mess.
